It is very early days in terms of DPA breach claims being made against private parking companies. Not one case in its own right has yet gone to court, although there is work going on off forums to trailblaze some cases.

The cases will be pursued in England and Wales and this is where some persuasive outcomes might be possible. Scotland is a different kettle of fish in terms of 'small claims' and I can't see any of the forums dissipating effort away from E/W at this stage.

What I'm saying is you'll be on your own and have to do all the Scotland-related research for prosecuting such a case, then take it through the necessary legal stages up there, which as I understand it, are much different than down here.

Unless you're legally trained/qualified or keenly follow and are au fait with Scotland legal procedures, then this is not something to pursue - at the moment. I say 'at the moment', because you have 5 years to pursue in Scotland (6 years in E/W), so you have time to wait and see how things start to pan out.

Thank you for your reply. It's exactly what I was looking for and I will follow and keep this in mind.

It sounds like UKPC will probably go out of business before the 5 years are up, as they are subject to a winding up order by HMRC at the moment but it will be interesting to see what happens.

    Thanks again.

I can almost guarantee that they won't (effectively) go out of business. They're making millions. This will be some ruse. A Phoenix will rise.

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

No doubt, they won't disappear! But I wouldn't think you could try and go after them years later when they have a new name etc...

Time will tell whether this 'winding up order' will actually be effected, or whether it is just part of a process where they will avoid the precipice.

We've not seen a major player go this way for many a year.
