    Isn't the fence to the left yours and the fence to the right the house next door. IE you only have to mend/replace your side if needed.

    The only issue the OP has is whether the fence actually cost the neighbour that amount of money in the first place.

    I don't know whether or not £450 is a reasonable price to pay or not. It probably is if it is a reasonable length and using 6 foot panels. But the OP agreed to pay it and pay it he must.

    The neighbours may also be short of or desparate for money. The OPs financial situation is of no concern of his neighbour's

    Whilst I genuinely sympathise with the OPs situation, I'm afraid that he is best advised to raise an overdraft or similar to pay the neighbour but get a receipt and pay by cheque.

    There is some good advice on here, and I dont think you have to worry about a solicitors letter, it will cost them approx £75 just to talk to them, and then another £75 for the letter, they are just trying it on with you as your on your own.

    Firstly, find out who actually is resposible for that fence, if its thiers, then they havent any call to expect you to pay for it.
    You were being nice offering to pay half, so whats is thier flippen problem, you have explained the situation, and you are only going to be 4 weeks behind.

    If they were worried that much about affording thier holiday, they wouldnt have gone in guns blazing puuting up a fence.

    Plus, you havent any proof to what they actually paid, there is no receipts etc, I think your neighbours are pulling a fast one,and let them go to a solicitor, ( they wont) as they havent a leg to stand on.:mad:

    i am going to try and do that, but im unsure if HSBC will extend my OD , i only have £800 limit on my capital one card and im up to £650 on that

    I am getting slightly confused here, wmxlad hasnt actually said if the side is his or his neighbours fence, so therefore he should hold back on paying anyway till he actually knows for sure.

    TBH, I wouldnt give in to thier demands till you can actually afford to pay it, and you said 4 weeks time, like Wendy says, if it went further, they would have to declare the dispute as well, and they wont want to do that.

    It has become their concern now though hasn't it?, i feel sorry for anyone faced with these situations, i would personaly offer to pay them in installments, i certainly wouldn't !!!!!! up my bank account or credit cards just because the neigbours want some money(small installments of around £30)
  • My main issue would be the lack of reciept. Did you have any say in the contractors employed?
    In view of the fact that they can't produce a receipt, I would ask for the name of the company and then ring them. I would also ask for a couple of other quotes from reputable companies just to give a comparison.

    Also, if paying for the fence was going to cause the neighbours such financial strife, should they not have asked for the money up front or at least asked you to pay your half directly to the company concerned.

    Morally, if not legally(?) you need to cough up something but also (morally) they should provide proof of the amount.

    I agree that you shouldn't be bullied into putting yourself into debt.

    Could you have an off the record word with your solicitor?

    my house will probably be repossed before it sells given the current climate :(

    They are pulling a fast one because they want their money...if the fence even cost £450...which you don't know because there was no receipt.
    DO NOT put any money on your credit card.!!!
    I'd write a very polite letter saying you will contribute to the fence as you promised but you can only afford to pay £X amount per month and they will have to be patient as you have a cash flow problem due to your car being fixed.
    let them contact their solicitor it will cost them money every time they need advice and a letter writing, let them take you to the small claims court - without proof of a receipt for the work they won't have a hope - as the solicitor will tell them!
    They can take running jump over their new £450 fence!!!
