No, the Council no longer have an obligation to house MoT.
IF there is to be an appeal, the County Court may order the Council to house her, but without that, they do not have to house her.
Current eviction date of 21 January still stands.0 -
Floss2, so to sum up, Does anyone in authority have to re-house MOT, or is she literally homeless as from Monday, I am having real problems understanding in this day and age why someone won't help MOT and her twins.
If the solicitor decides to appeal on the point of law, would this entitle MOT to stay on a little longer, or does the original eviction date stand, I have tried reading through the thread again, but there is so much of it, I thought it easier to ask so I and others fully understand the implications of today.
nobody has to accomodate her now unless a court orders it when /if they apply for an appeal.0 -
I'm still confussed as to why it was not considered important to take the medical reports into consideration. Could this be considered on a 'point of law'? If they (reports) formed part of the original decision and the medical report alluded to the prudency of a more indepth report (can't remember exact wording) then surely this is a very important point.

sorry lamplady but this is not right. the authority will not have to accommodate her if she does not find alternative accommodation. There has not been a change in her material circumstances since her previous application for homelessness was dealt with and therefore they do not have to accept another one.

That's right, but councils do not children sleep on the streets. In reality MOT will be offered something, though not necessarily anything very nice. With the mental health evidence, there is a good chance of her getting supported housing of some sort as she is seeming to struggle with managing a tenancy. However, getting supported housing can take a little while, so accepting a crisis option from the council may be a much better option than taking a private route.
I work for a mental health charity and we deal with a few people who have lost tenancies through mental health problems. Those with children are ALWAYS offered something, whatever their history.0 -

this depends on whether they considerd the information and decided it was not relevant they are entitled to do that. it would only be a relevant point of law if they ignored them completely.0 -

in reality she will not be offered anything by housing, social services may accommodate the children to avoid them going on the street by paying for b and b or putting them into foster care if they beleive they are in danger. it has not been accepted that there are mental health issues by the housing authority or she would have won the review.0 -
So because she doesn't have a time machine, and can't take someone back with her to report on how she was then they ignore it??
I can only guess how everyone else is feeling, but the one thing this thread shows is the support available, albeit only emotional. Many people on this forum have serious financial problems of their own, but they pale into insignificance beside the sheer inhumanity of this decision. It may well be legal, but it is immoral.
