    Oh Ampersand that was beautiful and just what the twins needed to hear last night as we believe there to have been an 'intruder' in the building:eek: We were quietly watching IACGMOOH when there was a knock at the front door (this can only have been from one of the 'inmates' as there is a main front door for which we all need a key to enter) there stood this young man, earrings dotted all over his lobes, baseball cap and wearing a very loud patterned hoodie. He aksed if we were ok and had we heard anything as the back door of the house had been left wide open and a 'person unknown' had been seen in the building. Told we were ok and had a brief chat about him, his g/f and his hoodie:rolleyes: closed and double the door and settled back to the tv. DD not at all happy and wanted to go to I-T's straight away, but eventually I settled her and we went to bed and slept and slept - best night I've had in ages:j

    The issues are:

    DEPRESSION AND ANXIETY

    Based on the information provided, the applicant appears to have developed symptoms of depression and axiety folling the break up of her marriage and in the context of stress at work. She is currently in receipt of fluoextine (Prozac), a standard anti-depressant agent at 20mg once daily (standard dose) and takes propranolol, a beta-blocker to help with syptoms of anxiety at 10mg thrice daily.

    There are no other relevant medical issues.

    The issue appears to be one of intentionality, and wether the applicant was sufficiently incapacitated in her decision-making, such as that she was unable to organise her finances and pay her rent. As is the case with depression, this can slow cognitive functioning and cause aviodant patterns of behaviour. There do not appear to have been any psychotic processes in the context of the applicant's mental health difficulties - this is often the reason why an indiviual may be deemed to lack capacity.

    Whilst it would seem likely that the applicant's mental health difficulties may be contributed towards her difficulties in paying her rent and her subsequent eviction, based on the limited information provided, it is difficult to say that she was not capacitous in her decision-making at that time.

    However, it may be prudent to obtain a pscyhiatric report relating to the events leading up to the incident in question, and I would of course happily review this on receipt of more detailed information regarding to her mental health issues and the event in question.

  • Hold on, your LA took this assessment as proof that you could manage your finances? I'm flabbergasted! I deal with medical assessments daily and if I'd received one like that I would have requested further info because that assessment is incomplete!

    The bolded bit, also on medical assessments there is usually a decision - there is no decision on this report! Why hasn't the LHO requested a pscyhiatric report? How dare the LHO use this report AND her own observations to make a decision on your mental health at the time you started to accrue arrears, quite frankly I am disgusted!

    Gforce, you have totally echoed my thoughts. I guess my solicitor can make something of this then for the appeal?

    I hope so! I'm really disappointed with the LHO's behaviour, at the very least she should have asked you if you had any additional supporting evidence that could be resubmitted to the Dr.
    The assessment is actually quite fair IMHO.
