If MOT is in a similar situation to me, she probably couldn't afford the deposit, and a months rent in advance. I seem to remember private rental is not an option for her (otherwise she would have gone down this route long ago).
Appt with solicitor tomorrow at 11am in SE London, so I-T hotfooting it to train and tube straight after school armed with the 'file' in which are some very nasty bits from the LL who is just a complete and utter liar in some of the things he has said - but as the saying goes "What goes around comes around" so maybe when my old home goes up for auction in December that will be his downfall;)Christians Against Poverty - www.capuk.org0 -

Rang Head of Housing and said that there was not enough time to prepare my case and therefore I wished the case to be heard at a later date - so THE APPEAL DATE IS NOW DECEMBER 17TH 2007 AT 9.30AM
This also happens to the date that I have to leave this flat so I questioned her about what would happen IF I lose the case - theoretically we have to leave that day but she appreciates that would difficult so would give us until the 18th/19th to vacate. However IF I win then we stay here until we are found somewhere!
Great work on getting a later appeal date.
Two things here
1) if the review goes against you the authority has to give you a letter confirming the decision they also have to givr you reasonable time to find alternative accomodation which is usually 28 days because you have a priority need (twins) however given that the review date is the week before christmas I would think that they should give you an additional week at least to take account of the fact that the estate agents are closed any thing less is challengable.
after the hearing the authority has to consider the evidence it has been presented with and investigate any further info that you have provided. they can not possibly do that in one day and if they do that it is challengable as they can not have given reasonable consideration to your case in that length of time.
secondly you do not have to leave the flat until the authority have been granted a possession order at court which they have to apply for after date of expiry of notice. if they are grated a possession order and baliffs warrant before a decision on your review they have to accommodate you elsewhere so it is unlikely that they will go for order until decision m,ade.
oh and thirdly you will have to decide whether you want shelter or a solicitor to assist you they can not both assist you at the same time as they are both funded by legal services commission.

This is my first post on MSE, I have nothing to ad re the excellent advice you have been given but I would like to say that if positive thoughts and cyber hugs could fix things for you then you would be home and safe by now. I won't post again but I wanted to tell you I am rooting for you and am sending those hugs and thoughts by the bucketful, I wish you all the best and will be reading avidly to make sure your much deserved happy ending arrives sooner rather than later.

Its me I-T burning the midnight oil again! Went to bed but couldn't sleep so decided to get up and catch up on the thread. I know I've been quiet for a few days but I've been busy with work & other exciting stuff; being photographed as a beaten up railway worker for a poster campaign about people who attack rail staff. My ugly mug is going to be at 15 national railway stations! MOT has really been a busy bee and so have you lot (sorry that sounds rude - our friends is better). Thank you for all the fabulous work you are doing, the information and advice you have provided. I have prepared letters for the two ex tenant families of the Farmhouse for MOT to get signed and I have prepared my own very lengthy letter. I shall go with MOT to the solicitor in London tomorrow and hopefully we can get some sound advice and assistance. All I've got to do is keep MOT awake as she falls asleep at the drop of a hat these days. That's depression for you though and in any case, sleep is good. I have tried to re-assure MOT's DD & DS that they are NOT going to be taken into care. It is difficult to figure out what DS is feeling because he locks it up inside him and finds it difficult to express, but DD lets you know exactly how she is feeling and the fact is she is really terrified about their future. I don't think the twins will calm down until that future is settled. The *+#="*! landlord has a lot to answer for, with the HO following close behind. Surely the Review Panel will see that with so much support MOT must be justified in her homelessness claim? Anyway let us all hope and pray to whomsoever you believe in that this all comes to a happy end. If it does, the party is on, for those who can make it. Having made so many wonderful friends it would be a pity to lose you all. Maybe we could go on a UK tour. Now there's a thought. I reckon there's a book in all this at the very least.0

I've only just found this sorry saga and have spent the last six hours reading all through the thread.
It strikes me that one way for MOT to get out from under the ******s at the LA is to find private accommodation and yes I know she can't afford it so suppose everyone who reads this donates an item to be sold on ebay with the proceeds going to a MOT rent fund with the payment going directly to an account set up specifically for the purpose? Surely enough small sales would generate enough revenue to pay a deposit and, say, six month rent?
I don't know whether it is allowed - though I cannot see why not - and I am certainly not suggesting setting any sort of precedent but if we can get her out from under the LA then she can later apply for HB (I think) for occupying a private property.
Does this make any sort of sense.
Please feel free to shoot me down. Anyone else any thoughts.
Needless to say it is clear the LHO has her own agenda and helping MOT doesn't appear on it.
(I started a search on this site at 7.30 last night, found this particularly distressing situation and couldn't stop reading - now my husband is going to want to know why I was so late in bed!!)

I know this has been floated around but what about some publicity in the media. If we could get them to agree to anonominity for MOT. Due to her and the twins situation. I feel sure that if the Local Media flagged this up it would open up the floodgates for a whole lot of other people who have been treated to this HLO brand of "Service". I feel that there must be others out there who have either lost hope and are in a dire situation.
Has anyone got any views or thoughts on the anon thing with publicity thru the Media? Do you think there is anyway as a forum we could contact the local Media and let them view this to see how the story has evolved etc;
Speaking as a journalist we are always keen to name the people in our stories, unless there is a legal order in place preventing us doing so.
I've seen stories dropped because the people involved wouldn't agree to be named or photographed.
There are a variety of reasons behind this from legal implications, to pages being more visually attractive with photos, to making the story more authentic in the eyes of the reader.

And I thought I was up late! What on earth were Minieri and Princess Jane doing up in the wee small hours? Thanks for your thoughts and ideas Minieri which were very generous. To be honest, if I had the dosh I'd have paid for MOT to get housed a long time ago. Well, off to London with MOT to see the solicitor and hopeful of getting ourselves on the road to a good appeal. No doubt MOT will update you all when we get back. Let us hope that they have some sound ideas and some positive suggestions. Keep 'em crossed. Ciao.0
