    Could someone point me in the right direction of the Saunders v Hammersmith and Fulham LBC 1999 case law please? Can't find it!

    AND I've remebered what I wanted to say - the Medical Report from the Council was assessed by none other than NOW MEDICAL!! The Dr there asked for it to be looked at by a psychiatrist who said there was no case to answer:eek: There was a previous post about NowMedical (which I can't find:confused: ) but it was a warning that this firm are very harsh with their assessments.

    Realise you have this, but it's all the solicitor will need to trace precedent.
    Checking on NOW MEDICAL too - but, once again, they will know all about them.
    So, don't worry too much about doing their job for them. You and IT have been battling alone in this for so long, you will perhaps not realise until - I pray - this firm takes some weight from you. You won't believe the difference this will make, although it sounds obvious. Suddenly, you will be contributing in a team, rather than going up the glass mountain under a cosh, which is how I felt.

    I love their offered 'service' of telephoning reports and in one day! They obviously don't need to meet the people much of the time.
    LA's are invited to simply fax cases to them for this.
    Now, now floss, for shame - there is a cheaper £10 service available in some categories for 'responsible' LA's.
    The three cases they puff - Pereira, Crossley, Osmani, pale against those unwon and offer little parallel with mot's situ. Pereira is at least good for showing how another LA, South Norfolk, more transparently runs its Appeals process.
    There's another point I'm checking - but let's hope it's academic by the time mot and IT return and that we amateurs/former's can bow to contemporary professionals.
    I wonder if Dacorum gave NOW MEDICAL £1450 for this:

    A recent case in the courts stated that the local authority could not rely upon an opinion from a now medical doctor if it differs from applicants own doctors, UNLESS the doctor from now medical had given the client an examination.

    Saunders v Hammersmith and fulham lbc 1999 west london county court.

    Mrs saunders was evicted for rent arrears when she applied as homelss she was founf intentionally homeless. Mrs saunders has 2 teenage children and received the then family credit. she presented a list of her espenditure and said she was unable to afford the necessities of life on review the council suggested economies and confirmed the earlier decision.

    Mrs Saunders Appealed to couty court successfully The court decided the decision was irrational even with the suggested economies she wold be unable to pay her rent also the authority dis not follow the procedures set out in homeless regulations because the officer who made the original decision participated in the review along with a more senior officer.

    This case is very similar to mots and I beleive relevant .. I would include thsi in the review process forthem to consider.

    Hi all,

    We're back!!

    First of all the C,S and F appt for 4pm was re-arranged by THEM again to Monday at 4pm here at the flat:rolleyes: .

    I-T and I got to sols at 11am and didn't come out until 1.30pm! Saw P who is a caseworker (v.good, v keen) for the first hour or so then her BIG boss came in and looked over my case. He said that a Section 202 case is hard to fight, but he wants as MUCH detail as possible about the case and my health. We have to go back on Monday as we ran out of time before twins came out of school.

    Big Boss also said that they will deal with the case for eviction here on 17th Dec as a seperate matter as the dates for leaving are not reasonable.

    Will post some more later as and when I remember it or maybe I-T will ;)

    brilliant news There is no way even if the decision goes against you that the local authority can get away with giving you reasonable time to find alternative accomodation.

    You seem to have found a good solicitor I am so pleased for you.

    mot - can you not send twins to school on Monday with note, REGRETTING, but firmly, that this new time is not possible[you do not need to say why - 'unfortunate diary clash' or similar is sufficient]

    Just one big hit per day from now on - and the twins will know that maman's Big Thing was this wretched school meeting on the day.
