    My file is available for collection so fetching it by 5pm.

    Appt made with Shelter for next Thursday (earliest they could do it).

    Still wanr a solicitor - the one ampersand suggested for me (kindly) won't represent me on legal aid.

    Rang CLS - given me name of another local solicitor who I am ringing as I type - no reply - ITS BLOODY URGENT!!!!!!

    Rang Head of Housing and said that there was not enough time to prepare my case and therefore I wished the case to be heard at a later date - so THE APPEAL DATE IS NOW DECEMBER 17TH 2007 AT 9.30AM
    This also happens to the date that I have to leave this flat so I questioned her about what would happen IF I lose the case - theoretically we have to leave that day but she appreciates that would difficult so would give us until the 18th/19th to vacate. However IF I win then we stay here until we are found somewhere!

    I have everything crossed that something comes right for you. BUT I would argue that it is not reasonable to expect you to move the day after the hearing if things go the wrong way. Letting agencies etc may not be open etc on the run up to christmas, so how are you going to find somewhere? I would have thought they would at least let you get christmas out of the way. And she thinks she is doing you a favour!! Flipping heck!

    I dont know how you are managing to keep going hats off to you,xxxx Have you heard back from your local councillor yet? I know that the local elections are not due till May but surely all councillors should be falling over themsevles to help you at the moment as they are gonna need your vote.
    This HLO I just want to strangle what the hell does she think shes playing at, :eek: assuming, well insisting really that she is going to win this appeal :eek: and so complete her "perfect" score.:eek:
    I am keeping everything crossed that you can get a "rottweiler" of a solictor onto this and that they wipe that smugness off her.:eek:

    Someone has to set a precendence and I along with every other poster on this thread hope pray and keep everything crossed that the person setting this precendence is our own "MOT" a Dinasour of a Mother and wonderful advert of Humour and Kindness in Adversity.

    Within this, follow their directions and find this:
    Homelessness
    i. Making an application for accommodation as homeless
    ii. Local authority duties prior to making a homelessness decision, including providing temporary accommodation
    iii. Section 202 Housing Act 1996 reviews of local authority decisions
    iv. Appeals to the County Court under the Housing Act 1996 on a point of law
    v. Judicial review against local authorities for failure to provide accommodation in accordance with their duties
    vi. Judicial review against the Home Office/NASS for failure to provide asylum support in accordance with their obligations
    vii. Appeals to the Asylum Support Adjudicator in relation to decisions to withhold asylum support
    Straightaway I like the fact that they list housing as a separate area, which isn't an option on the Law Soc. site. The breakdown looks thorough and made for mot's situation.
    I feel annoyed that Pictons didn't suggest anyone else to mot.
    For some reason, back from diphtheria jab and wound biz, have stormed in,zapped putah into Life[most unlike me]to know the latest and have Mr Nick Cave darkly and beautifully accompanying me(a fairly recent introduction via a fellow Antipodean).

    Yes, Floss, appreciate all the pro's and con's of approach to Councillors - I floated it thus - but WHERE/HOW does mot receive her fair Hearing?
    Let us remember what 'hearing' means - surely, any Appeals Councillor worth his or her salt, would wish for the opportunity to question BOTH Parties.
    mot will NOT be 'HEARD' BEFORE jUDICIAL REVIEW.
    Please everyone, think hard and post here.
    Remember, this Council's m.o. is to decline Appeals, thus forcing Appellants to pay for the costs of both sides at JR, regardless of outcome.
    Hopefully, FM could sort that out.

  • I know this has been floated around but what about some publicity in the media. If we could get them to agree to anonominity for MOT. Due to her and the twins situation. I feel sure that if the Local Media flagged this up it would open up the floodgates for a whole lot of other people who have been treated to this HLO brand of "Service". I feel that there must be others out there who have either lost hope and are in a dire situation.
    Has anyone got any views or thoughts on the anon thing with publicity thru the Media? Do you think there is anyway as a forum we could contact the local Media and let them view this to see how the story has evolved etc;

  • council would need to go to court to evict and then get baliffs to evict you physically - it aint gonna happen before Xmas.

    If you are now paying rent and have this breathing space before your appeal, shouldn't you be using your time and energy to find a private landlord who would house you? You could offer to sign over HB direct to landlord to get rid of worries of you not paying.

    With interest rates on the increase, there must be loads of new landlords who bought with the BTL mortgages desperate to fill their empty properties. Each week their houses are empty is money they have to find to pay the mortgagees. A tenant wanting to move in quickly would be a dream, benefit claimant or not.

    Publicity is one thing if you are on your own - would your kids be cringing in embarrassment if they were a feature in the local paper?

    If MOT is in a similar situation to me, she probably couldn't afford the deposit, and a months rent in advance. I seem to remember private rental is not an option for her (otherwise she would have gone down this route long ago).
