  • Court claims don't begin and end with parking tickets.
    But thanks to POFA 2012, a parking ticket is the only example where a claim for breach of contract can be made against a person who was not even party to that contract.

    PPCs go to great lengths to mimic "real" parking tickets issued by local authorities and other statutory bodies. Statutory penalties "time out" after six months - why not amend POFA 2012 to bring private parking tickets into line by including a new clause giving PPCs just six months to bring their claim against a vehicle's keeper to the Courts? The existing statute of limitations could still apply - but limited only to claims against the driver.

    Yes, as I said earlier, a statement of truth is the way forward.
    The onus would be on the claimant and if proved false, the courts can deal with that.

    I doubt the courts would want an extra burden as they are busy enough. Doubtful the public would approve of more data release.

    You can imagine how much the BPA will lobby against this, turning up all suited and booted, shaking hands with old friends. So WE need to encourage every newbie with a story about ANY private parking scam, especially those with court claims and CCJs, to send snail mail copies to land on Mrs May and Sir Oliver's desks, day in day out.

    This is the new clamping - credit clamping - and we can influence decisions right now, as they are listening.

    Correct but not only those with these problem, it's also those for the future who don't know yet.

    Interesting. I wasn't aware council tickets timed out at that stage.

    I would not be averse to a statutory limit being set in line with council tickets. In my own opinion the parking charges on private land should have a statutory founding and be regulated by a government body, rather than one of two trade associations.

    The current idea that parking charges are contractually agreed is a little farcical and leads to a bizarre situation where a ticket at a retail park for a genuine customer overstaying is enforceable but, arguably, a ticket issued to a non-permit holder parked where they aren't welcome would not.

    Put everything on a statutory footing and have it robustly regulated, rather than trying to bend law that was developed before cars were really a thing to fit the private parking world.
