I dunno, if I was issuing legitimate invoices for goods or services provided, and never had any acknowledgement, I'd be issuing a conducting a trace first as I'd actually want to be paid.

I guess if I was just spamming out fake invoices and trying to intimidate people using a numbers game, I'd be more interested in getting the CCJ than the money.

The problem is partly that the rules of service allow for this scenario to arise. They don't require that a trace be conducted unless there is reason to believe the debtor is not at the address in question.

Whether not receiving a response to correspondence is such a reason or not is open to question. As we know, a great deal of people ignore these tickets as standard practice!

PE use equita (a capita member) to instigate a trace AFTER a CCJ has been recorded to harras people for moneys , why not before issuing a CCJ or even court papers?

The courts live in the dark age and not in 2016. They are flawed and open to abuse from the likes of ParkingEye

Before costs PE money, after they can add to bill.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

I'm involved with trying to help out one of the Carers who attends my wife. She fell foul of Excel in 2011 and followed the prevailing advice at the time (including the BBC lawyer) to ignore. She is now getting the threats from bwlegal.
I've followed all the tips so far from pepipoo but they haven't dropped the case yet.
I've complained to the SRA and also sent a strong worded email to my MP about these sharks. To judge from the MP's reply they havn't a great deal of interest in righting the ongoing injustices.
I just hope all the national press outlets take up the cause.

It all changed in 2012 when the government decided scamming was good.

You should go back to your MP saying that you do not have any interest in voting for him/her AGAIN

There are some very poor MP's around

See what happens with BWlegal, so far there no indicating results as to what they will do. So far they have been ridiculed in court
    and that will probably continue

Thanks Beamer that makes me feel a bit better but I feel bad for my Carer lady as she just can't afford to be ripped off like this. To make matters worse with my MP he is a junior minister.
I have relied to him telling him in no uncertain terms what a lame reply he gave me when I expected action.

    Hi All

It was the article in the DM that brought me here today.

I have had a couple of PCN from Asda, Morrisions etc over the years and always donated them to my local recycling centre, however I'm now a little more concerned. (I begrudge paying for parking when I'm spending £150+ on my shopping).

Can anyone tell me how these companies are obtaining CCJ's? Specifically I was always under the impression that these were 'invoices' as opposed to fines and therefore no obligation to pay them.

If this is the case then how are these cowboys getting away with it? Also, has the advice on these type of tickets changed now? I always read/heard to just throw them away.

    Thanks in advance
Advice changed in early 2013, the year ParkingEye served over 30,000 court claims...

    Read the current advice:

    http://forums.moneysavingexpert.com/forumdisplay.php?f=163

NEWBIES THREAD, near the top, tells you what to do. The advice is clear NOT to ignore a fake PCN, except in Scotland, NI, or if it's a non-BPA or IPC member (e.g. ANPR Ltd). Always read the sticky threads stuck at the top of any forum, they always have the current advice on a subject.

If you have an Aldi one, PE do not seem to sue over any of those so the agreement that have with Aldi is likely to preclude court. You can complain to Aldi though, of course.

Re a PE PCN from Morrisons, if you have the PCN number somewhere, even an OLD PCN, simply email:

    donotreply@morrisonsplc.co.uk

Don't worry about the 'donotreply' part - it does work! M's alwasys cancel them now because they appear to be stuck with PE for another 2 or 3 years, thanks to whoever thought it was a good idea to sign a 5 year contract with a parking firm, with no ban on court claims against customers.

Morrisons customers are being sued in droves by ParkingEye, as are people who use Welcome Break Services, people who dare to park at Barnet and other Hospitals, people who dare to use the Tower Road car park at Newquay...the list goes on.

The current 'credit clamping' scandal is far greedier, aggressive, upsetting and worse than car clamping used to be. Needs exposing.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

Good for you. He is a junior minister, there is nothing stopping you to let Theresa May what you think of this "junior minister"

A non interested MP is not in the interests of any party
