Did that earlier today. No response yet. Probably busy in the subsidised eatery that we pay for.0

But he is the courts minister not some ordinary MP.
I doubt he told the Daily mail he would not deal with them. Infact he told them that he would investigate the claim.
You should reply pointing out this fact and that you expect a suitable answer from him
Makes one wonder if there is a hidden agenda here
Did that. Just got a reply signed by Christine Heald ( family on expenses I suppose) saying that they had passed my email to the Min of Justice for cosideration.
So much for that I suppose now that Sir Humphrey has got it.0 -
I still say that Sir Oliver SHOULD be copied in to every complaint send to Mrs May about any private parking case which has got to pre-court template stage or is/was at court stage or has resulted in a CCJ. I don't care if his wife is rejecting emails as unimportant; why is he the Courts Minister then?
Basically re anything that is not just at appeal or debt collector DRP stage, posters should be encouraged when we reply to a thread (and I've seen Umkomaas do this already) to send a copy of the court threats/claim/judgment to Mrs May AND Sir Oliver Heald - and I would do this snail-mail, not by email.
Reason for snail mail being the method of choice for this campaign is, I've always worked in Senior Admin roles for too many years to remember - now in education but previously in mortgages - and having a load of postal complaints land on your desk regularly, especially about the same issue, gets noticed and is pretty annoying & time-consuming.
Emails are EASY to fob off and forward, sweep under the carpet. So instead, encourage snail mail copies with a covering complaint setting out exactly how this 'parking shark' court threat from a despicable industry which includes ex-clampers and money-grabbers is affecting you and your family, pointing out that the whole scam balances on a house of cards (often with no trump card - no evidence and no cause of action - just a 'joker'...).
Yet in many cases (BW Legal claims/letters for example) the keeper cannot be liable because many firms do not use the POFA wording but still litigate & get CCJs against the non-liable party. That cannot be allowed to continue. The POFA Schedule 4 did not envisage that keepers who were not even driving/can't drive/are not liable should have a default CCJ 'credit clamping' them without any recourse except paying a stupid £255 to set it aside.
As for ParkingEye, they do tend to use POFA wording when they send a PCN in time (not if late). But they are very easy to complain genuinely about, pointing out to Sir Oliver Heald and Theresa May that they issued over 30,000 court claims per annum including at Hospital car park sites where NHS Parking Government Policy from 2014/15 specifically DISALLOWS their incentivised penalty business model (i.e. they only make money from fines = incentivised).
Or complain pointing out the basic facts - that the driver was merely shopping at Morrisons (or whatever) and now you are being intimidated by court threats and have to duck this for six years despite the ticket being undoubtedly an unfair penalty, as IMHO it was in the case of Mr Beavis' ticket in 'ParkingEye v Beavis', where the Supreme Court Judges asked lots of off-piste questions but never asked the obvious question 'well Mr Beavis, why were you delayed?'
And quite how those Judges (except Lord Toulson who dissented) could justify the 'charge' by CAPITA OWNED ParkingEye, based on the argument that the company could not function if it didn't charge that amount beggared belief as commercial justification for fining a consumer disproportionately!
This whole scam has got to stop.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I wish I shared your optimism. I know how these things work in Government as I worked for over a year in a section of the FCO dealing with correspondence addressed to ministers.
Correspondence was handled a follows: a junior officer would draft a reply which was passed to a more senior officer for scrutiny. That person would them send the draft reply to the Minister's Private Secretary who would machine sign it and post it to the writer. The minister would never see it.You never know how far you can go until you go too far.0 -

You seem to have missed out the quill sharpener from the process, TD.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Yep but someone has to deal with it, whereas emails galore could be continually swept under the carpet in two minutes flat by Christine Heald.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It has to work that way. If the Minister were to read and respond to all correspondence, they'd never get any work done.
But I'm sure that the PPS would advise the Minister if they were getting large numbers of similar complaints about the same issue, and the Minister may then start to take a personal interest.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -

In today's world Ministers need to watch their backs.
The big broom of Theresa May could sweep them into the back benches .... just like that and that includes Sir Oliver
If Mrs May gets this right and cleans up UK Ltd, there is every chance she will win the next election. Failure to the people could mean she will be out0 -

Hi
I am looking for any help or advice. We applied for a mortgage on Monday and we're turned down due to CCJ. After contacting the court we were informed it was from parking eye. Parking eye confirmed it is from the 25th March this year at an Aldi car park and we overstayed by 7 minutes. I know everyone has the same story, but we never received any mail from parking eye and the court admitted that they outsource all their mail to a third party and there have been issues. So now we have a CCJ on what was an impeccable credit history and no idea what to do next. I don't want the CCJ to show as satisfied I want it off, has anyone ever had any experience with this?
Any help would be greatly appreciated we are devastated by this.
Thanks
Michelle0
