Right, having read this, let's help him 'ensure' the system doesn't remain open to this abuse:Courts minister Sir Oliver Heald said last night: ‘These are serious claims which will be looked at urgently. Our legal system is world-leading and we are determined to ensure that it is not open to abuse.’
Everyone who gets a BW Legal or Gladstones or ParkingEye or CEL (or other) claim, should send a copy to Sir Oliver Heald with a covering formal complaint about the failings of the system that allows this, explaining how they feel about a private parking firm being able to issue template 'robo-claims' as a form of debt collection against people who are unlikely to even be the liable party (in CEL, Excel and VCS cases the keeper can't be liable):
https://www.oliverheald.com/contact-me
and a copy (of course) in another envelope to:
Rt Hon Theresa May MP
10 Downing Street
London
SW1A 2AA
And if we get any new threads here about CCJs having to be set aside, I suggest we now all remember to post that link and quote Sir Oliver Heald.
We need to encourage EVERY victim we see here (and on pepipoo, CAG or Legal Beagles or wherever else you post) to complain to their own MP and to send a photocopy of the paperwork and a covering letter to Theresa May and Sir Oliver Heald, complaining about this utter scam being allowed to happen to ordinary families.
They need to see repeated examples of this 'credit clamping' by parking firms and hear how it has affected each honest family, whose only mistake was to move house (or not appeal, or lost at appeal) and may never have been the 'liable' driver anyway.

As the Prankster has said in his blog,
"The Prankster has suggested to the British Parking Association that the code of practice should be updated to require parking companies to verify a motorist's address before taking legal action if they previously had no contact from the motorist and therefore no confirmation the address they were using is correct.
The BPA debated this change but decided against it.
ParkingEye's Mark Anfield is a director on the BPA Board of Representatives."
Same incest as Gladstones / IPC /IAS
Something to be pointed out to the Daily MailPPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:0 -
I emailed Oliver but just got an email back saying he could only deal with his own constituents.0

The main reason for problems seems to be not updating dvla with new addresses, like this chap.

Did you not say in the letter that you were contacting him as Courts Minister, not as your representative MP?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I emailed Oliver but just got an email back saying he could only deal with his own constituents.
But he is the courts minister not some ordinary MP.
I doubt he told the Daily mail he would not deal with them. Infact he told them that he would investigate the claim.
You should reply pointing out this fact and that you expect a suitable answer from him
Makes one wonder if there is a hidden agenda here0 -
And now read this
Theresa May vows to investigate
