Well he says he sold the car to me at a price that in his eyes covers any possible repairs anyway
If there's evidence he's trading then he can say that as much as he likes, a court will disagree. As will Trading Standards, and (likely, though not definite) the tax man, and the local council if he's doing this from residential premises.0 -
ebay can be used to show if he is a trader or not. Go to a current add or old one if you still have it on your watch list. Select the option to see sellers other items. Screen shot any cars for sale. Now under auction type select completed items which will show all items advertised by this ebay user for around the last 6 months. Screenshot all the car listings. If he is selling more the 2-3 cars a year he is a trader and the court would accept this ebay history as evidence of his trading status.
Selling more than 2-3 cars a year doesn't categorically prove they're a trader.

Fair comment but the OP has confirmed evidence of the seller advertising 3 cars in a month including the one OP bought which is clear evidence of trading.0 -

Sorry, but I still have to take issue with this as a statement; I've sold multiple cars via eBay in the same month (actually over two months, but four elapsed weeks) before - the last time I did it was February 2015:
Sold my Volvo V70 as I needed a vehicle with a greater towing capacity. Bought a cheap '96 2.5TD Jeep Grand Cherokee to replace it.
Liked the Jeep so much that two weeks later I bought a 2003 2.7CRD Grand Cherokee to replace it. At the same time, my wife bought a 2004 MX-5 from the same garage - we'd been looking for a while and they just happened to have one in the right colour (black on black) and spec with aircon, so we snapped it up (to replace her Saab TiD with DPF due to her changing jobs and a very short commute).
So in the same four week period I sold a V70, Grand Cherokee, and a Saab 9-3.
And I'm still, very definitely, not a trader.
The activity you describe is clear evidence that the seller in this case may be a trader - but it's not enough to start slinging around as a fact.0 -
If the car was sold as a private sale, that's exactly what it was. If this guy is buying cars to sell on, he's effectively running an undeclared business, but that's for a court to decide.
You'd need to prove that this guy isn't just selling a bunch of cars that he owns and wants rid of.
As for the faulty car, he has confirmed he was aware of it before sale, didn't mention it, therefore liable for repair or refund. Simply listing the car as cheaper than others and not disclosing why isn't an excuse.0
