When we sold MiL's flat after she died, the purchaser was a nightmare. They dragged everything out, attempted to gazunder, you name it....
In the end I gave them an ultimatum to exchange as they claimed they needed 3 weeks between exchange & completion even though they were part-exing their house and had a 3 week grace period to move out. Why should we beat the risk? Given they already owned and it was a property for the over-55s, they were incredulous that they would need 10% on exchange. Our solicitor was fantastic throughout the whole process - in the end exchange & completion happened within 2 hours of one another.
2 days later the solicitor rang to say she had received a message from their solicitor demanding window keys. If we were unable to provide them, they would need to replace the windows affected (I kid you not!) and we would pay. Our solicitor said she was embarrassed to phone us but duty bound to do so. She did not charge for her reply to them, which from memory referred to the reply in Arkell vs Pressdram. And yes, replacement window keys are available for a quid or two....0 -
So, as promised, here's the tale of my sisters house move. This was 15 or so years ago so I can't remember all the details.
My sister & BIL sold their small 2 bed flat & had exchanged on a 3 bed semi. Completion day arrives, they're all packed with the movers ready to go. Their vendor refused to complete & move out and went down the 'I'm a black single parent, you can't force me out' route as her reason for not completing. She would not be persuaded that it was in hers, and everyone else's best interest to complete. My sister & BIL went ahead with the completion of their flat and had no option but to stay in an hotel. They were there for 3 weeks.
Their solicitor got some sort of eviction thing for the vendor, who did move out but she then rented the house to a family, my BIL found that one out when he was passing by and saw lights on, he knocked on the door and the tenants told him they were renting from the vendor. They had no idea of the situation they had unwittingly found themselves in.
My sister, BIL & their 2 boys, who were aged about 12/13 at the time, all moved into a rented flat and their furniture went into storage. Various court procedures happened, including the high court and after many, many months, they finally got into the house. There were huge sums of money involved, to be honest, I'm not sure if my sister ever got back everything they had to spend out.0 -

I can't even begin to visualise just why anyone would act the way that vendor did. What's in it for them to act that way? What sort of accommodation situation was that vendor moving to herself?
But then I suppose that's expecting people to act in a logical/sane fashion I guess....0 -

I guess the dad has, or had a job of some importance/position of authority where people have to listen to him and do as he says so he expects it from everyone

It was so many years ago that I can't remember where she moved to and yes, it's incomprehensible isn't it? As far as I recall, it was explained over & over to her the consequences of not completing, however, she refused to budge. My sister said at one point that she didn't want to move into the house, she just wanted to sell it. Understandable in the circumstances but of course, they did move in & they are still in the same house.0 -

He was seen wearing that yellow jacket - ie of the type workmen wear.
Probably not very likely then....:rotfl:.
His attitude was somewhat chavvy too - another reason for very much doubting he had a job of any importance/authority.0
