That puts my mind at ease, thanks Silvercar.

IF the council are insisting that you go through the whole eviction process, then you need to keep your LL/agent in the loop - to prevent it becoming personal.

yes I intend to minimise the landlords inconvenience as much as I physically can but if I cant find another private rental I will have no choice but to do this. 15 agents now and only 2 said I would be considered by the landlords on their books:(

Just to add that if you can't find somewhere and do end up going through court and being evicted by bailiffs then you'll be liable for the court costs (about £360 I think) and the costs of hiring bailiffs (no idea how much that is and it depends on whether their county court bailiffs or high court enforcement officers).

The council will help once you are evicted.

Eviction is a legal mechanism, it doesn't have to be acrimonious and if you are well prepared its simply a case of handing over keys to a bailiff.

Well that's understandable - a relatively small proportion of houses out there are big enough to cope with 9 people!

I am assuming that the landlord can keep this from my deposit, or will they then go via small claims court??

It's usually part of the court order from the possession hearing

I am stunned that the council wont help until it gets to this stage, I hope I will find somewhere but if not I'm scared about this process, the thought of going into a b and b with 8 kids is horrible.

    Why?

There are people being evicted today, and tomorrow and... You still have a perfectly valid tenancy until you are legally evicted. You aren't homeless.

The council needs to help those people today.

They will help you when the time comes. It may be a b&b to start with, or other temporary housing, but there are clear guidelines on when you will have secure social housing.
