I blame the PPI scandal. All of a sudden "miss-selling" became the new buzzword and people seem to think it applies to everything.

Agreed. Mis-sold and Not Fit For Purpose are the great get out clauses these days so people dont have to accept ownership of the bad decision they made.

    Hi all,
Not sure if this is the right section. We took out a 2yr PCP with on Nissan Leaf in October 15. concerned re no drive to charge but were assured it wouldnt be a problem as so many pod points all over sheffield, one of the best places to have an electric car they said! We quickly realised it wasnt fir for purpose and struggling to charge it as we are a terraced house. All the promised pod points aren't as they seem. We have one super charger 4 miles away which is eother in use or not working and is counter productive as we then have to drive home! Others are cable which we bought and there are 5 within 3 miles however 60% of the time they are out of use! we get there and are unable to charge the car leaving us stuck! We have a 2yr old so life is busy and we spend too much time trying, often unsuesessfully to charge it. We went back to the dealership in November to complain but no help offered, manager sympathised it wasnt ideal having nowhere to charge it! Only option was to swapto petrol at great increased costs to ourselves which we cant afford. Persevered as we had no choice. Went back last week as we just cant manage, we have a new car that we are paying monthly for and cant use it! Again little help only offer was to take out a new PCP for 2 years trading in leaf which huge negative equity on the cheapest nissan a leaf at £236pm (we pay £155pm)
We beleive we should never have been sold this car or allowed to have it due to having nowhere to charge it. We have also written to Nissan head office who didnt want to know.
Ive logged this with Financial Ombusdmun but we have to write an official letter to dealership first.
Any help and advice would be appreiated....do we have a case? What so I need to include in complaint?
We were just going to pay the outstanding finance off and move on but we don't feel we should have to be at a financial loss.

    thanks in advance x

Sorry, but even a small amount of due diligence on your part would have uncovered the fact that this car didnt suit your needs.

I certainly wouldnt have been buying on the basis that there "might" be some new charging points built near you in the future.

But they still have to comply with the Consumer Rights Act, tell the truth, not mislead customers and conduct themselves honestly in pre-sales discussion. Which sadly for too many salespeople is beyond possible.

When I was buying my car it was a case of working out which salesman to trust on the basis of which one had apparently lied the least. All main dealerships... ;)

The way to do it is not to trust the opinion of just one saleman. What you should do is do independent research online. This allows you to get a true picture of how good a car is and what the facts really are.

Then whe you decide what car to buy go and speak to a salesman.

    Can we do that?

We have 15 payments left on PCP-we were told we can just pay this off and hand it back?
Nissan valued it at 9k giving it a 5k defecit....

    Look up your finance agreement.

There will be a figure mentioned of 50% of the total transaction value. Once you have paid that, you can hand the car back with nothing further to pay.

You will find that point is closer than the end of your agreement, and i dont think there is anything to stop you handing the car back and writing a cheque for the difference between what you've paid and the 50% marker

If you're deemed to be negligent in how you've left it dangled, then you'd be liable.

Something like this would be a good solution, though.

There's lighter-duty/shorter/cheaper - but for use on the pavement, I'd go for the medium.

Thats what i'd be doing - and charging the car in the evenings.

    No, you can't sell it.

You are renting it with an option to buy at the end.

    Yes, you can sell it.

Its simply a matter of selling it, and having the buyer pay the amount directly to the finance company and the O/P paying the shortfall at the same time. The finance company will then issue an email declaring no financial interest in the car and the buyer can pick it up.

    Its done all the time.

Surely no-one believes anything said to them in a car showroom.
I can afford anything that I want.
Just so long as I don't want much.

I wouldn't have bought an electric car if the only way to charge it up at home was to string the cable across the pavement. Now that you are in this situation, who cares, just string it across the pavement and get it charged up. Just get one of those walkway cable cover things to make it safe. It's no different to when people string vacuums out or hoses when cleaning their cars.

And the cars probably parked there for hours. Plus it might be able to provide enough power to get you to a fast charging point later.
