    like i've said, i cannot definitively say that my lad wasn't throwing stones but i can with a lot of confidence say that the original chip claimed was not as i have spoken to a few people including autoglass who said " I wouldn't have thought that such small stones would cause a star shaped chip of that size, they would have have to have been thrown with quite some force"

  • What do you want us to say? Your question was answered in #2, that's the legal stance, morals are down to you, you're the one who has to live there.
    yes and the legal standpoint was of great help, the rest is a lot of people saying "what if" and "he did it" or "pay up" without really considering (whether or not you agree with my take on it) if it was your child and whether he was throwing stones or not you can't say for sure, BUT you have doubt in your mind of, A. the possibilty of such a chip being caused (taking into account the factors) and now of the integrity of the claimant, Would you pay up?
    see the question has evolved along the way and brought into question my morals, i don't really know why i feel the need to defend my morals but i just do, because they are in question now, you understand any of that or is this just stupid now?

    Here's how it is.

    Your son threw a number of stones.

    He was seen doing so, but not by you.

    It is alleged he caused damage.

    You are not prepared to pay.

    He is below the age of responsibility and cannot be held responsible.

    You will have to live with the consequences and the neighbours

    There is nothing else to be said to make you feel better about it.

    My kids wouldn't have done it and are not the subject under discussion so what I'd do is irrelevant.

  • OP, do you by any chance live on a council estate in the North East? Throwing stones at cars was a pretty common game for the four year old street children of my former neighbours.

    If you think the neighbour is trying it on, don't pay.

    Then the neighbour might take you to small claims over it as you should have been supervising your child. You might lose.

    You do have to live next door to someone who feels you "owe" him £400 for years (unless you have already sold up)

    You might find that hoodie wearing "yobs" pelt your car with half bricks in the night on a regular basis for example......

    (I practise the cult of "Never forget, never forgive", I'm sure other people do too)
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))
