    I have phoned the airline and my flights are booked so I just need to find another hotel. Do I still go ahead claiming the full amount paid for the package holiday or do I need to just claim for the accommodation?- I know seems a bit of a silly question but from what I have read people are claiming the whole thing back!

    Hi..Spoke with Paypal a few days back..Guy assured me that I would get a refund, but they just had to wait the regulation ten days to allow Low cost holidays to challenge the claim ..Which of course they won't..Because they cant...(his exact words )....

    I think people are getting far too ahead of themselves if you think any bank is going to pay the full cost of the holiday when you only have to pay for the accommodation, you cannot have two bites of the cherry. The reality is no one is going to be refunded for weeks and some may be very disappointed indeed.

    Banks have no real arguments against section 75 claims against credit cards but they do have defences against chargebacks on the basis that if you booked a package holiday ( as opposed to accommodation only) then by law there has to be financial protection in place. There was, it is just that it is completely inadequate and some may only get the £8 or so being predicted by the government in Palma. At this stage I think everyone should make claims to whomever they can but at the end of the day, you cannot get back more than your outlay.

    Interestingly the local Director General for Consumer Affairs in Palma is quoted as saying that hotels cannot charge customers again, they can only claim in the insolvency of Low Cost. That makes legal sense as Low Cost claimed to be an agent of the hotel and by law, if you pay an agent, it is deemed payment to the Principal, but I don't know many (or indeed any) are taking a blind bit of notice of the law, having not been paid for months and months.

    I contacted you travel after seeing they had actually booked my hotel for Low cost holidays...They say the booking still stands, but they have not been paid for it by low cost..So I would have to pay them (again) in euro's in order to secure the hotel booking...and it was a few hundred more..They are not ATOL protected ..so I told them to poke it....I have secured alternative accommodation...

    I phoned them again today...got through to a lady (far eastern I think) and told same as you..It's now gone from three working days to 7-10 working days...She said it's the sheer volume of claims they have had over 20,000 customers (Lloyds TSB ) affected...
  • when I found out about Low Cost, I rang the hotel I've booked in Verona for September, and they confirmed the booking was still valid and paid for! I emailed them next day, and they've emailed back to confirm booking "is paid for"

    I'm still dubious, but if I have an email confirming, then surely it's ok?

    YouTravel can't hold an Atol. They're a bedbank.

    If the hotel has e mailed you proof ..then you should be legally covered ...You must have dropped lucky there....take the e mail with you when you travel..Just in case....
