    I hope he didn't say that. s. 75 protection goes much further than the Visa chargeback scheme.

    I very much doubt he said raise a Section 75 claim against a debit card. Section 75 does not exist when it comes to debit cards. It's only applicable with credit cards. You can do a chargeback though with debit cards. That isn't legally binding, and there is no guarantee you will get your money back.

    Yep I misheard marain sorry s75 nowt to do with debit cards with debit cards it's chargeback only sorry

    The above link throws doubt on s.75 claims.....I do hope we are covered and banks will do the decent thing but I fear the worse.....

    I have instigated a claim for my hotel fee...With Lloyds TSB...I paid on my debit card...Initially the Bank Manager said ..its not a credit card so not covered under s 75 ..I then told him about the chargeback rules..He said oh..It will have to go to the administrators...So I showed him this...Its a bit of a read but worth it....

    Banking giant Lloyds TSB today urged customers who had paid into the collapsed Christmas savings club Farepak using its debit or credit cards to apply for a refund.

    A total of 150,000 people were left out of pocket to the tune of £35m after the Swindon-based company crashed weeks before the festive break.
    Trade minister Ian McCartney described Farepak's closure as a 'national emergency' and a relief fund was set up to help families.
    But Lloyds TSB said any of its customers who have lost out should ask the bank for a refund on payments made using its credit or debit cards.
    The bank explained it had already refunded more than £100,000 to around 100 people, but was sure other customers would also be eligible for a rescue payment.
    Paul Pester, managing director of consumer banking at Lloyds TSB, said: 'We always protect our customers when they use their debit or credit cards for purchases.
    'If they don't receive the goods they have paid for we will refund the payments and we are happy to be able to do this for our customers who have made payments to Farepak using our debit or credit cards.'
    In fact, any Farepak victim who paid in amounts between £100 and £30,000 using credit cards is protected in the UK under section 75 of the Consumer Credit Act 1974 and can also apply for a refund.
    Refunds on amounts paid using debit cards is an issue for the individual bank and anyone concerned should contact their card issuer.
    However, customers whose banks use Visa debit cards will be able to look into applying for a refund using Visa's 'charge-back' scheme.
    The Bank Manager changed his tune then..Went on the phone ..And registered my claim there and then..Issued me with a claim Ref number..Saying they would be in touch within three working days...You need to be a bit forceful in your dealings with them..And once they know you are "on the case" they will help you...It's called "custom and practice "..Once they have done this for one incident..They cannot simply say no to other customers..I am not 100% sure what the outcome will be..But I have lost £1500.00..So I won't be walking away from this...
  • what might help people, go to your card issuer website, find if they make claims of 'protection if firms go bust'. This proved useful on my call to sainsburys bank, at first they were trying to avoid the claim, i stated the reason i took the card out was due to them advertising this as a sale point.

    They have told me i will have the money back within 10 days now
  • i've made two payments to Lowcost using 2 different credit cards from different banks. My flights are confirmed, so need to claim hotel and transfers under section 75. The amounts paid do not match the individual elements of the holiday cost and therefore i do not know which card to claim against.
  • I booked hotel accomodation in Spain for a fortnight through lowcostholidays for 6th august. I paid an initial £700 via paypal (14th Feb) which then comes on my credit card bill, the remaining balance £1133.23 was paid (29th April) with a visa debit card. From my accomodation voucher it states that my booking was made by hotels4u on behalf of lowcostbeds/lowcostholidays. I contacted the hotel and they said they still had the booking (from thomas cook ???) but someone would be assessing things tomorrow ? I also contacted hotels4u who said they were aware of my booking, but that it would be getting cancelled this week and I should book alternative accomodation and try to claim my money back ! Who and how do I claim money from, paypal, credit card, bank debit card or all of them ? I have flights to Spain and am still not sure whether we (wife and 2 young daughters) will have a hotel room or not which is not ideal when it is less than 3 weeks away ! Any advice would be greatly appreciated, thanks.
  • What a palava!!

    So I have a double whammy. Booked to go to Turkey next month. cleared my lch debt in May. Flying out with Easyet (confirmed) with flight details. Flying with Pegasus on the way back (confirmed by them) but no flight details been sent to me - according to them they cannot send me my flight details as they have been booked through LCH! So am awaiting an email from them confirming my details.

    I have had confirmation from my hotel that my reservation has been cancelled. So will have to rebook.

    I have requested a refund through Barclays Bank - they are sending me some details in the post which I need to complete & return. I am wondering if they should have emailed me the documents instead?
