    But you have no right whatsoever to try to get somebody's criminal record in relation to property letting. You can't terminate somebody's tenancy because of any criminal record they may or may not have, either.

    I'm not trying to terminate his tenancy because of that. Just not renew his tenancy which expires on August 2nd.

    The police have been searching the property. I have reason to believe that it is something to do with drugs, specifically heroin.

    Well, that's fine. You don't need to know anything about his arrest in order to do that.

    If he's done nothing wrong then we will maybe consider renewing the tenancy as he has been a good tenant otherwise.

    I get your point - but I'm not totally convinced re that actually. "Insufficient evidence" is a bit of a different matter to "Absolutely no evidence - and for obvious reasons (ie because they are definitely totally innocent)".

    The jury is still out imo re Cliff Richard imo and I honestly dont know whether he is "guilty as charged" or "no smoke without fire" or been bad-mouthed unjustifiably just because of one persons "personal opinions" (and I DO know what that feels like personally....darn it...).

    So - it could be much the same applies to your tenant.

    Kudos to you for trying to work out whether he really IS "guilty as charged" or no - but I'm not rating the odds personally of him being innocent.

    My sympathies to you - because, in your position, I would be doing exactly the same and trying to work out whether the tenant was innocent or no. If they were innocent = they would be staying. If they weren't innocent - they would be out quicktime and no appeal iyswim.

    You don't have to renew the tenancy you can just allow it to become a periodic tenancy.

    It doesn't make much difference if you have a fixed term or the tenancy is periodic one so I'd just let it go month to month after August 2 no matter what the outcome.

    Have you given the tenant a notice requiring possession on August 2nd?

    So, no, you don't know that there was any illegal activity taking place within the property.

    You need to make your mind up based on the things you know and are relevant. And the law says that criminal convictions (if and when they occur, which they certainly haven't in this case) are not relevant.
