Liverpool Business Park PCN

Hey I have read the newbies thread but need a little more advice. I received a PCN in the post today (dated 11th May) from VCS for 'stopping on a roadway where stopping is prohibited' at Liverpool International Business Park and was just wondering whether the template offered needed to be reworded for stopping as opposed to parking, or can it be sent as it is?
I pulled into a small layby section off the main road as I took a wrong turn and was stopped for 2 minutes max whilst getting directions on my phone - of course I would not do this whilst driving as it is unsafe. As I was about to pull out I was waiting for other cars to pass so it was safe to move off, one of which is actually in one of the photos they have taken. Just my luck a van drove past at that point but how do they expect me, or anyone, to read small signs whilst driving to say that you cannot stop, without stopping?

A layby. What is a layby for? Presumably vehicles. Was there any notice there defining who was permitted to use the layby?
My suggestion is, should it come to court, to major on or around this point. But as you have read the NEWBIES thread, you should be able to form an appeal.0 -
Layby is probably a wrong term, sorry. It's like a side road but it's all been cut off now with nowhere to go. I stopped in there in order to turn around once the road was clear.
I tried to post a photo but it won't let me being a new user :undecided It is where Garston Shore Road meets Estuary Boulevard if you can google map it?
Although there are lines, there is no route to continue on the road for vehicles to drive on, and I certainly wasn't obstructing anything.0 -
This is essentially a scam as it is impossible, as you say, to read the signs without stopping. As a result VCS never go to court for this location, although they do at other locations.
As the IAS is essentially a kangaroo court, you will not win any appeal. Your choice is therefore either to go through the motions and appeal, or ignore.
Personally, I am in the 'appeal' camp because each appeal is a nail in the coffin of the IAS as their bizarre judgments show them either to be corrupt or incompetent.

you can add it to the end if you phrase it as ..... the driver stopped ......
but to be honest I would just send the template as is ......
because you will not win any appeal you do ......
the template is to warn them that the keeper understand that this is a scam ... and that they will find it impossible to answer all the questions without giving the game away /....
this is a contribution that I like to make re airports and VCS in particular ....
The scammers that infest some of the smaller airports are in cahoots with said airports as its is a (allegedly) mutual financial arrangement ....
Go back several years and you would have won this at a POPLA appeal ..... however in the world of PPC's they created another trade body (the IPC) that have a (again allegedly) kangaroo court :eek: (the IAS) The IAS seem to treat appeals as a lottery 80%+ loose irrespective of the evidence.......
you therefore can, after reading the below, do the first appeal (a new template appeal for the IPC is available) ,and then ignore .... or do the appeals as a paper trail.
A while ago VCS did try out a small claims court case over such ....and as predict that they pulled out before the trial ..... . They did not dare try placing this before a real judge! and have not yet tried again ..... I wounder why ?

The point where you stopped if you noticed there is a mound of soil/rubble placed across the road. This little road was an existing road for airport traffic when this was the airfield. The boundary for Peel holdings is the line of rubble. On the other side is National Trust land.
People used to drive further up that road park up and take their dogs for a walk or walk along the estuary footpath. So off Peel holdings property, as if by magic that soil/rubble mound appeared as it did on the other nibs of roads, so stopping people getting off their property and forcing them to stop on Peels land.
Off topic but this has caused locals much inconvenience, so much so that the council has had to mark Banks way with DYL and kerb blips to stop lorries waiting to enter the estate. The warehouses do not have anywhere to park off road and if they are early they stop on the road and get a charge.0 -
Thanks for the advice, I have now sent the template letter as it and decided not to add any further information. I will wait and see what comes back. How long will it be before this charge is cleared from any records if I wait it out?
esmerobbo - yes the mound is still there, how terrible of them! I can understand why they put lines down to stop lorries parking along the road but this small off section of road is out of the way of the main road and does not cause any harm to stop there for short time. Especially to turn around!
What is the next step for me, I will get the rejection letter and then what?0
