thought i had better update this after such a long space of time.
he was refused PP by the council so he went to appeal........ again!
this time he went for an informal hearing which was today, wont know the result for a few weeks.
I have to say i couldnt of done it without soappie she is an angel sent from heaven who even attended the hearing with me today.
I will let you know the outcome, but of course there will be a subsequent application as he is stubborn as a mule and determined to get it.0 -

Almost two years he's been chasing this planning permission. :eek:
Bet he's kicking himself really. He originally had his own house on the market and could (and should) have sold it at the height of the market in 2007. Now he's been messing around for years, he'll get much less for his own house if and when he does finally decide to sell.0 -
Gawd, hope its not him whose going to be living in it when/if it does get built, sounds like our neighbour from hell. The council did a good job there really - we hadnt even seen the plans but they objected twice on the grounds it would be overbearing to us and detrimental to our privacy and enjoyment.
He then staggered the new top storey back about 10 feet from the ground floor extension and got it through.
I wish we had never set eyes on him though - nothing but trouble since. Very best of luck with your guy.0 -

well i think he is having trouble getting his section 106 from the building society, they have been saying he will get it for 2 months!! (a section 106 is what he has to get to fund the heathland mitigation fee, and his buidling society/bank need to say they are ok with him severing the land), and as we know if house prices continue to fall, as seen as he got 100% mortgage 4 years ago, hopefully it will dropped enough lol.
he should of sold at the height of the market like any sensible person but hes greedy lol0 -

section 106 is the heathland mitigation fee, baically a bung so the council can provide 'open spaces' if you build within 500m of a protected site.
at the moment the fee is £1500 per new dwelling, but of course your mortgage co has to release the land for you to build on, and i think he is having trouble getting this.0 -
Divadee - is there much more to this story than you are letting on? There seems to be much anger in your feelings towards your neighbour when all he wanted to do was develop some land for a profit. He went through the proper channels to do so which gave you the right to provide your feedback for why you believed the development should be refused.
I'm just curious as I have seen neighbours in the past get incredibly aggressive as soon as a development notice gets posted (once I was the neighbour trying to obtain planning to have a velux put in my bathroom and had to fight like crazy with one particular neighbour who felt it was his duty to maintain the road I lived in in it's 1930's original condition). Sometimes there are deep rooted reasons for this behavious that have little to do with rational thought or the development itself.
