    No, I don't work for the police and never have done but my hubby works for the Met as a Custody nurse.

    Whilst it is correct that it used to be easy to get RK details from the police, this has changed dramatically in the past few years now that every single log in to the PNC has to be recorded and officer accessing it can be called upon to justify their reason for doing so.
    Because of this, it's not just a case of sending a letter or turning up at the desk and asking for the details.
    Any such requests will now receive the response that you should contact the DVLA and submit the request form to them.

    The Police cited data protection and refused to give me RK details when I asked them when I was submitting the completed crime report. I am just saying what actually happened.

    @Silver-Surfer I suggest you refrain from getting into arguments on who is more correct with other posters and focus on the facts on hand. While I respect all opinions shared you do seem to derail the thread. Alternatively, I am sure there are other juicy threads on this forum you could follow :beer:.

    You should have cited the road traffic act when filling in your collision report. No crime report for this crime, stick to facts and get them correct and you'd have the information you need. :)

    TP insurer says they are still waiting for their insured to respond.

    My insurer now says if TP accepts liability they will waive my access if I choose to use them... or I can go directly to TP.

    In case of a positive outcome, is there an advantage for me to using my insurer over theirs? My insurer certainly sound more friendly and their approved repairer is just across the road from where I am.

    The main advantage to using your own insurer is that you can involve the FOS if you have cause to complain about anything to do with the claim (once you have exhausted your insurers complaints procedure). If you go directly to the TP insurer then you cannot do this as you are not their customer.

    Reviving this old thread with new developments.

    TP was refusing to talk to their insurer for a while. Finally got around to it and denied hitting my car. Said the damage to their own car was prior damage sustained elsewhere.

    So far I have not claimed off my insurer or theirs, was waiting to see how this would go.

    Meanwhile Police sent me a letter saying that they would make further proportional enquiries before making a prosecution decision.

    What happens now? What do I do?

    If it was me, I would send a formal letter before action to the TP listing the damage to your car. Indicate that as far as you are concerned, the TP was responsible for the damage and you want reimbursing within 14 days otherwise you will make a claim through the small claims court. Suggest that the TP may like to pass your letter on to his/her insurers to deal with.

    Keep proof of postage and a copy of the letter.

    Your other option is to claim through your own insurers and pass on the TP's details to them to deal with.
