    Further question once the defence is sent and I'll check it's reached Northampton, does anyone know roughly how long before you receive DQ and how long before it needs to be sent back as away for a week or so shortly and don't want to miss next step in process, quite looking forward to day in court and monies back for all this hassle.
    Also when win want to go to press for all those other bods who unwittingly pay this low life company.

    The timeline depends upon the processing court's delays - how high the pile is!

    Being away for a week or so is fine, you will not miss a DQ deadline.

    Oh, and the Equality Act 2010 protects everyone who meets the definition of disability and is silent on Blue Badges. It sets duties (legal duties under statute, not optional) for service providers so I would add it into the mix.

  • Great stuff guys final thoughts are awaited from Parking Prangs ter then post updated defence and wait to see if the cowboys seriously want to take this all the way. No problems with permission about disability as close relative. GRATEFUL THANKS

  • Hi. Update is defence filed. Just received Direction questionnaire from solicitors asking for the case to be heard on papers alone, but have downloaded Bargepoles advice so thats a no there. Bit naughty of them as they are stating that if I don't agree to the special direction then the claim be transferred to the Claimant's home court!! Just means they'll have to fork out more in expenses for travel and maybe an overnight stay!!
    Also received my Notice of Proposed Allocation to the small claims court today with the Directions questionnaire so will need to get going on that.
    Will continue to update as this looks like it's going all the way. Really don't think the solicitors have consulted with their clients before forging ahead with this, but then their fee is more important than a win.

    Gladstones appear to carry out no scrutiny, these are copy & paste 'roboclaims' and you should object at every stage. This latest template 'hear it on the papers/or at the Claimant's local court' letter is mentioned on every Gladstones thread, like here where I suggested what to do in a covering letter with the DQ that you are sending to the court and G's:

    This will be at YOUR local court, make no mistake. Their letter should be reported to the SRA (Google how to report a solicitor).

    If it is free then yes, use your insurance legal cover'. Not if it isn't free.

    It would be interesting to see if they think the Beavis case crushes all defences. If they think that, they are very much mistaken.
