    I don't see how that is possible. It's part of the public carriageway as far as I am concerned. So are we to believe that the layby isn't maintained at public expense when the LA sweeps the road? Is it possible to see a detailed plan of the road?

    StephThe chosen one - I'm due to take this to court in the next couple of months. Witness statement due in a couple of weeks as defence filed. Need to elaborate on points and to decide if I name driver or not as don't want partners relative involved .Thoughts on this please as if named would it be a better witness statement?
    Advice on any other points too for witness statement as there seems to be more on location now than 6 months ago. Has anyone beaten claimant at this location? Maybe I'm the tester for future action!!!!

    Maybe you are the first on the forums (you won't be the first to get a claim) but having that recent blog from the Prankster is useful.
    Need to elaborate on points and to decide if I name driver or not as don't want partners relative involved. Thoughts on this please as if named would it be a better witness statement?
    If partner's relative is the Defendant (keeper) then they have to attend the hearing, there is no getting away from that. It is too late to name the driver once court action has commenced but the driver can always agree to pay if the defendant doesn't win. Or am I remembering who is who, the wrong way around? You are not the Defendant, that's the partner's relative, yes?

    The keeper is in the best position to defend if that keeper wasn't driving, because they can use the POFA as well as all the stuff about dodgy unreadable signs.

    SUCCESS!! CLAIM DISCONTINUED.
    Received a very trivial email from Gladstone solicitors, guess got email from my court papers. Just stated claim discontinued.
    Contacted local court but had to wait a few days as they were behind with all cases. Heard today discontinued.
    This is days before witness statement needed to be in but more importantly just before Claimant had to pay court fees.
    Now waiting to see if Parking Prangsterscase of a counter claim against claimant for costs, stress etc is won before considering if worthwhile taking action.
    No letter received for this cancellation just pathetic email and Parking company had still not removed charge from their Web site last time I looked!
    Huge thanks to all those who have supported this challenge.
    Message is Heath Parade NW9 parking charges can be dismissed even after court date set. Pass on the good news.:j

    be careful with this as you need to check with the court that it is actually discontinued , Gladstones may email you yet turn up on the day (or some LLP YTS trainee might)

  • Thanks for warning but if court say discontinued am hoping that is correct, that's why didn't put anything on mse as was suspicious of Gladstone email. Has anyone had acknowledgement of a dismissed claim from the court or is their word over the phone good enough?

    Just an update on the road - highwayscorrespondence @barnet.go.uk got back to me via email - I quote:

    "Dear Sir/Madam,

    Thank you for contacting the Highways Service.

    According to our records Heath Parade, NW9 is not an adopted road."

    If you need to tell us about another issue, please do so, using the Report-It function on the Council’s website. You can save time by registering with MyAccount so you won’t need to keep re-entering your details.

    I asked for more clarity on what "not an adopted road" meant (I. E. Not adopted by the council or private party??) but heard nothing back.

    I too have sent my defence as of yesterday so hoping for a similar result!!

    Not an adopted road means the council don't have it in their responsibility for maintenance etc. Therefore it is private land.

    Just make sure you get that in writing from the court if you haven't already.
