    If it was sealed and untouched, how can you know for certain that it was definitely an iphone in the box?

    (Or is the packaging transparent so you could clearly see the contents?)

    I don't like your follow up email - far too accusational. You should always be polite and firm. Why threaten to blacklist and block? Just do it! If it has been stolen, it needs to be blocked asap!

    Well that is true. She has sent something back today, I will measure it at the delivery office. I have also completed the court letter and I'm willing to send it at the time I receive something else back.

    Seems to be the best way of selling an Iphone now on ebay is Icloud locked and the buyer contacts you on receipt to get it unlocked, they then cant say they didn't get it

    Playing devils advocate, you're a new account who could well be seeking advice on how to get away with your fraudulant sale of not-an-iphone.

    Very unlikely but eBay deal with thousands of complaints per day, and if there isn't clear and obvious guilt one way or the other will side with the buyer ...

    I hope you get this resolved but don't hold out huge hope. If you block the phone, they'll still win the case and get their refund... Maybe now they send you back the blocked phone? Who wins... You're down 600 and they've lost nothing.

    People are the worst.

    Well, it's not that simple. I'm a new account here,but not on Ebay. On Ebay I'm a member since 2013.

    Yeah, she sends it back? Doubt it. It's not blocked yet, neither had any iCloud set up, as it's a brand new phone. It was not even opened from the box. Even if she sends back the item, opened, I lost 100£ because it's got opened.

    Yes, I know what ebay does, that is why I am willing to take it to the court. It does worth me 60£ to try it.

    Yes, but with only 12 feedback, you're still effectively a "new" user (no matter how old your account is) - especially when selling a £600 item.

    As both you and the Buyer are in London, have you thought about hopping on a bus and going to talk to her?

    It's interesting - when they send you what they say they received, they are actually voluntarily sending you the evidence, a phone with it's own IMEI number and history and possibly finger prints. Most petty criminals aren't the cleverest of people.

    Yeah good question!

    I asked her, see reply:

    "When purchasing expensive things i always record and its a long practice of mine since first signing up for ebay. Exactly because people think they can get away and make money by scamming people online. I will not argue with you anymore. You have accepted the return request so you have a set number of days to refund me if not i will be looking to get in touch with ebay."

    I can tell you one thing, you will loose if you just follow the returns process. You can only resolve this by getting on the phone to eBay, and not just once, follow it up. If eBay say they will investigate, what has happened to me, 7 days pass, the buyer clicks escalate and get their money, so you will need to act fast and pester eBay to resolve before the 7 days are up.
