    Maddogb - surely the simplest way to gain our support is to give us the details of your sadly now departed car and demonstrate via autotrader, etc, that the valuation is wildly incorrect?

    Your persistent refusal to do so simply seems to demonstrate you know you cant justify your stance with actual data?

    You will be taking them to court as a small claim, and they will judge your claim on its merits and its merits alone. They will not make any declarations of illegality.

    And if somebody other than a court can make any declaration of illegality, then I'd love to know who. Simply saying something is illegal doesn't make it so.


    Courts don't make a "declaration of illegality" they make rulings and when those rulings are about whether a party has acted against the law, that is indeed a "declaration of illegality"

    yes that is the law.
    you have signed something when you took out motor insurance? maybe you should have asked a grown up first.

    "justify your stance " why should I need to do this? it has nothing to do with the logistics of arguing with an insurers valuation.


    I did not ask for someone to help me roll over and "take it"
    I don't need someone to tell me what cars I can afford with the measly pay out they want to give me.
    I don't need someone to tell me I'm wrong for no good reason.
    I don't need people debating the merits of one car or another at various price points.
    I don't need someone telling me how much work I should be prepared to do to save my insurers a few quid out of their millions of profit.


    I've already had all of this as well as some raving lunatic who only pops on here to insult me..

    If I though posting the full legal argument would be understood here I would, but at the moment I am happy to follow through with the infinite monkeys theory :)
