CP Plus ticket in Scotland

Just found here from a search on Parking Control Services
I know I've done some stuff in this which isn't what I should have but hopefully I can get some advice and support here.

In October last year my partner Parked her car in a Glasgow Hospital where she sometimes works, She returned to her car and found a notice.
She has had notices before for parking in permit holder bays, with these she showed her hospital ID to an attendant they took the ticket and cancelled it. (I have since found out this one is for not parking in a bay but I don't believe this makes any difference)

With this notice she spoke to an attendant, and they took the notice and told her it would be cancelled so we thought end of story.

in early January we got a failure to pay letter, I phoned the number on the letter and told them what happened and was told I would need to email in and given an email address, this was also on the letter, This was to Parking Collection Services.

I got no response, so emailed again, again no response.

Then the letter from a Debit recovery service, I phoned them and explained what had happened, they said they would not proceed and would send the file back to PCS but I should email,
I sent another email, No response,
I then found a different phone number on the original letter, and phoned that the lady there was very pleasant and asked me to forward my emails to her and she would forward them on to the correct person at PCS this I did yesterday.
Last night PCS replied that I was too late to appeal but any way the notice was correctly issued so we needed to pay.
I was at work so sent a quick reply saying time limits were nonsense as they had ignored my emails, and anyway this had been cancelled by their agent at the time,

I have now found another email contact for CP Plus, was thinking if PCS don't tell me its cancelled, I'll email them a final time explaining I bored with this now, the notice was cancelled in October so stop contacting me or send me a court date....

As I said I now know I should have just ignored but any advice for what to do now...

    Have you got confirmation it's been cancelled?

    You could contact them a final time (in writing), telling them it's already been cancelled, so drop it or issue court papers. It's unlikely they'll pay any attention anyway, so it's up to you if it's worth the hassle.

    It's vanishingly unlikely to see a court, especially if you've got proof it's already been cancelled.

    Personally, I'd just ignore them. Just ignore any future parking invoices too.

    You are in Scotland for goodness sake - don't waste another moment of time, phone calls, e-mails, or your breath, contacting these people who are no better than something you pick up on your shoe if you don't watch where you step.

    Totally ignore them is the best advice.

    Do you waste effort in contacting the scammers who send you e-mails from Nigeria, or some other unlikely place, saying you have won their lottery, or a long lost uncle has died leaving you money, and you just need to send them your bank details?

    No? I thought not - well these parasites are the same.

    and err yes I sometimes reply to Nigerian scammers... I did quite a bit of scam baiting for while,
    I did it safely with anonymous emails fake details etc....I'm just a sucker for punishment really

    Contacting them again will prolong the drivel you get back from them. They will think they have got a live fish on the hook who doesn't know that keeper liability doesn't exist in Scotland so will keep on harassing you. Don't encourage them.


    If they haven't got the driver's contact details they are stuffed. Making any sort of contact with these scammers increases the risk that you will let slip vital information that could identify the driver, hence the reason for no contacting them n the first place, or ever.

    It sounds like the driver has probably been identified though, but the outcome is the same; ignore them unless real court paperwork is filed, and then defend it. Scotland is a lot more pro-consumer than England, so it's more likely to go in your favour.

    PCS and DRP are the same debt collector company and are just shuffling it between desks

    they wont help you, so stop prolonging the agony and IGNORE them from now on

    down here we see loads of these issues with debt collectors and the golden rule is IGNORE THEM

    I am writing hopefully for the final time to have this notice cancelled (again),



    A brief history,

    The notice was issued on 22/10/15, the driver took the notice to an attendant either the next day or the day after. They showed their hospital ID and the attendant to the notice back and told the driver that it would be cancelled. At this point I consider that the notice was CANCELLED.



    On 7th of January this year we received a letter from yourselves stating the notice had not been paid. I phoned the number on the ticket and the person said they understood but that I had to email in and they gave me an email address. I email the address and explained that the Notice had been taken back by an attendant and therefore been cancelled. This was to a company called Parking Collection Services ltd.



    I received no reply to this email so I sent a follow up email on the 16th of January. I still received no reply.



    On the 4th of February we received a demand for payment from Debt Recovery Plus Ltd. I contacted them by phone and explained again that the noticed had been cancelled by the attendant and that I had emailed Parking collection Services Ltd and was awaiting their reply. The person on the phone told me as the payment was in dispute they would take no action and return the file to their client.



    I emailed again to Parking Collection Services again on the 7th of February again got no reply.



    On the 18th February I noticed a second phone number on you initial letter and phoned this I then spoke to a very pleasant lady at DRP Ltd. She told me nothing was lodged against the notice. She asked me to forward her my previous emails and she would then forward them to the correct person. This I did.



    Yesterday evening I received a reply from AXXX XXXs, part of which I have copied and pasted here.









    Thank you for your email regarding the above Parking Charge Notice (PCN).



    The time to challenge the charge has now expired and therefore access to the Independent Appeals Service (if applicable) is no longer available.



    However, in order to resolve this matter, I will offer the following comments as to why this PCN was correctly issued and is still payable.



    My findings



    The site in question is subject to terms and conditions, which are stated on signs throughout the area. Those signs state that all vehicles must be parked correctly within a marked bay.



    On the date in question, the vehicle was not parked correctly within a marked bay and a PCN was correctly and legitimately issued as a result.



    What you need to do now



    Please ensure that £40.00 is paid by 3rd March 2016. Payment can be made online or by phone..








    I find that she firstly states the time for appealing this has ended, How long is this period and when does it stop start. Please note that this notice was issued in Scotland so English appeals process does not apply.



    She makes no mention of the fact that the attendant at the time took the notice back and CANCELLED it,





    I believe that it is your selves that issued the notice so would like to deal with yourselves from this point on as dealing with three other companies appears to be confusing the issues.



    Apart from feeling feeling ignored and harassed at the same time.



    I want to draw your attention one last time, that this notice was cancelled by the attendant, and therefore we will not be paying.



    Please let me know that this is now the case, and that we will not be contacted again by PCS ltd, DRP ltd, or anyone else.

    CP Plus will say 'thankyou for your appeal, but it's too late because the case is already with DRPlus who are acting for us in debt collection*'.

    STOP!




    * for 'debt collection' read 'toothless desperate computerised letter chain from call centre teenagers at DRPlus, PCS and Zenith' (all the same).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    More waffle than Sainsburys, take the advice off the experts and ignore, these people have been dealing with these clowns for years. DRP only get paid commission on anything they collect, holy !!!! batman they say I have to pay, what a surprise. Doing nothing is harder than doing something, start today and practice ignoring, you will be quite good at it by the time of the next letter.
