Bought a fake! Major dilemma!

    what's going to happen to the "fake" bag ?

  • i would be very wary about destroying the bag even if it is fake. i had a similar situation with a fake gucci watch that i wanted a battery for, took it to a high st jewellers and they told me they had to destroy it as it was a fake but the police said they would be charged with criminal damage if they did break it.

Firstly, you would be grammatically correct to say 'is' instead of 'are', unless you make definition plural. I am aware of the distinction between libel and slander and you are to be applauded for undertaking research to back up your assertion (which any solicitor would do) although I do feel you have maybe taken offence where it was not intended. However, do you really feel you have to go to such lengths to assert your point of view? Thank you for the link to the particular legal firm's website, it proved a fount of knowledge(he said without a hint of sarcasm). If you really wish to hammer home your point of view, give me a particular case as authority, along with the name of judge venturing the opinion and if the opinion is obiter: not a brief resume from a website. As always, before I venture an opinion, the facts have been checked.

    If you are not a solicitor, what category of legally trained person do you fit within? Barrister? Para-legal? Licensed conveyancer? Legal executive? I am a solicitor incidentally. In Scotland we do not really use the term lawyer (only lay persons would do so, usually on the understanding it means solicitor), which is why I ask.

I infer from the way you frame your sentences you are not used to constructing pleadings - you leave too many holes in your argument for me to pick up on at a glance. Incidentally Barvid, the link you gave ie http://hosting.lawyerlocator.co.uk/hp/baehrs/defamation.html in fact backs up my argument and does nothing to further yours(!) I suppose you were off on the day they taught relevancy and specification at law school. Hope all of this helps you out a bit.

    I've been on this forum long enough to appreciate that it's intended to be a place where everyone can contribute, and I'm genuinely quite shocked at your postings, spinning hamster wheel. They do come across as very spiteful at times, which is something you might want to tone down - we're not sparring in court now! :-) It's a shame, though, when a thread is dominated by overly-aggressive or unnecessarily unpleasant posts. Picking up on grammatical oversights is a bit needless as it doesn't really help anyone's cause.

    All I was really offering was my own experience that some law schools now will not rely solely on the traditional spoken / written distinction but will include the concept of permanence. This seems to have really offended you for some reason, but I think we're in agreement now. Either way, we probably both know enough about the law to recognise that there are rarely absolute rights and wrongs, so it's all a little hypothetical anyway. Who knows - maybe a court will decide tomorrow that something said on the radio was slander and we'll both look dumb.

    Finally, just to answer your question, I don't work in any legal capacity, but I do have a law degree and am therefore technically a lawyer. In England, we do use the term lawyer - it means someone with a law degree. Doesn't relate to a job in any way, and I don't claim to be anything more than I am. I'm quite sure you have far more experience than I do in the legal field and constructing arguments etc etc, but I don't think you need to be quite so abrasive and over-the-top in trying to knock me down.

    Perhaps mine will be the last word, or perhaps yours will be if you add to the thread, but I am now signing off from this thread so I'll leave it to you to comment as you see fit... but please could you refrain from saying anything rude about me, or picking holes in any sentences I've written, or trying to demonstrate your superior legal knowledge (which I'm quite certain is greater than mine!).

    Jewellers are advised (although couldnt tell you by who) to destroy all replicas, my OH works for a jewellers and they do if they receive one for valuation or repair.

    I would be furious if someone tried to break my watch! Do they compensate you for destroying it?
  • Crikey -we bought an Abercrombie & Fitch jacket from ebay and paid the right amount (same as shop price - we live in the country).I didn't know they had a web site. It was listed as genuine but it turned out to be fake. I contacted A&F, told them about it. They asked me for a copy of all emails and the jacket (posted it to USA) and I could pick one from their web site. They duly sent it to me.
    Well done Abercrombie & Fitch, got a beautiful jacket.:T
  • Not sure if it's an urban myth but I've been told if you go through French customs with a fake LV bag they immediately confiscate it and if you go in a LV store with a fake they'll take it off you and call the police.
    My friend took a fake Rolex into a posh place to have an extra link put in, they quoted a price, but when he went to collect it they just said they couldn't do the work and handed it back.
