    My niece has asked me a question that I cannot answer, but perhaps the assembled experts here can, please?

    She works in a small shop, 5 days a week, earning NMW. Her current working hours are:
    Monday 2 pm until 7.3opm
    Tuesday 2 pm until 7.30pm
    Wednesday 2 pm until 7.30pm
    Thursday 3.55pm until 9 pm
    Friday in the winter 11 am until 2 pm
    Friday in the summer 11.45 until 4 pm

    She wants to know what holiday she ought to be entitled to.

    Also, if she starts working more hours, will she be entitled to more holiday? (I assume that she means working more hours during the 5 days, rather than working extra days.)

    I haven't seen her contract, but can we assume that it provides the statutory minimum of everything.

    Best to calculate how many hours holiday she is entitled to, then short days and long are all accounted for. So 5.6 weeks (legal minimum including bank holidays) x number of hours she works in the week. 24.5 hrs in the Winter and 25.75 in the Summer. So ~25 hours working week x 5.6 would be 140 hours a year.

    She would have to take off any time that she isn't required to work for bank (or other) holidays and that would leave a balance that she can book off for holidays.

    So, if she takes a day as holiday that she would normally work 5 hours, that's 5 hours of her holiday entitlement used up. Likewise, if she is off Christmas Day or another bank holiday, that is another 5 hours.

    I suppose that she would work longer contractual hours, rather than overtime, but I will check.

    I agree with SC's calculation :)

    That's how it should work. Small businesses can have their own ways of doing things though! So really she should check with them how they arrive at the calculations if she's not sure. They might just work it out as a fixed number of days for example.

    If her contract states that she should get more holiday than the above then the contract takes precedence over the statutory minimum and she is entitled to what the contract states. In the absence of a written contract/other agreement then the statutory minimum would still apply.

    If she does increase her contracted hours then she would be entitled to more annual leave and the business would have to calculate what that would be pro-rata according to the rest of the holiday year.

    Overtime, if it's guaranteed and compulsory, for example it is expected that she do an extra 5 hours every week then that would accrue annual leave; if it is just a bit of extra now and again then it would not.

    Can't think of any other implications/questions off the top of my head :)

    So CK is after an insurance expert, GDB needs an HR professional... I actually could do with an accountant for a quick query but I don't think we have one now do we? I know Chewy is but I don't think he's posted for quite a while now.

    It's a "big day" next door.... for 3 weeks scaffolding's been going up - that's been quite quiet as they started with the stuff closest to me and worked further away each day.

    This morning ... a GIANT crane's turned up and put his side legs out - and a huge lorry's parked in the road at the front laden with wooden framework. So I expect for the rest of the day I'll be in a slight state of acute anxiety as I see a succession of wooden frames being lifted from the lorry over the full height of the scaffolding and dropped into place on the inside of the structure.

    I do hope the scaffolders measured things correctly, so the frames do actually fit inside the scaffolding. There'll be a few red faces if not ;)
