Is the assumption that now the will says what is needed the poa is to make sure it can' tbe changed again, or even to start spending the inheritance before it is due....
...talking of POA Martin seems to recomend we should all have matching ones with our partners and it appears that you can get them for free if you are on tax credits.
For whatever reason, I'd assumed it would be automatic for a married partner. If that's not the case, I'd better look into it. Not much sense in undertaking financial steps to look after each other, only to leave a legal one undone. Thanks michaels. Please stay safe in the sun and learn the A-E of melanoma: A = asymmetry, B = irregular borders, C= different colours, D= diameter, larger than 6mm, E = evolving, is your mole changing? Most moles are not cancerous, any doubts, please check next time you visit your GP.

I meant to say, if she's not capable of making decisions and the will was only made recently, then surely there's an argument for saying the will is void if she's not capable?
That's absolutely true. But, assuming this is an LPA, it can only be made if the person making it has reasonable understanding of what they are doing. So, there's not necessarily a conflict, as both the will and the LPA may be valid. Indeed, the LPA includes a certificate (usually signed by a doctor or solicitor) that the person understands it and isn't being pressured into signing it.
The first stage with an LPA is making it, and the second stage is actually using the LPA when the person has deteriorated to the stage they can't make their own decisions. So, it is possible the LPA has been made, but not yet implemented.
We've been down this route fairly recently with my MIL. A few years before she died, she recognised that she needed help dealing with her finances. She could still make decisions, but she needed help as she lacked concentration. No reliance should be placed on the above! Absolutely none, do you hear?0 -
Another Youtube link but this time, it is not Josh's work but one James has put together with his good friend Aaron, the singer and writer of the song who now lives in Australia (he also used to be a very near neighbour, 3 doors up until he moved)
https://www.youtube.com/watch?v=akmc8Pd9NpAWe made it! All three boys have graduated, it's been hard work but it shows there is a possibility of a chance of normal (ish) life after a diagnosis (or two) of ASD. It's not been the easiest route but I am so glad I ignored everything and everyone and did my own therapies with them.

Wow! That's good!
Did I understand correctly that the singer on the video is Aaron, not one of your sons? But that one of your sons made the video?
Sorry to be dense! Am easily confoosed at the moment!(I just lurve spiders!)

Take a deep breath and try to break down your post into:
- What has happened
- What you think is wrong with what has happened
- What you would like to happen instead
- An idea of your ideal path from point 1 to point 3
There are a couple of solicitors that post (for free) on there that will hopefully respond. Clitheroekid is particularly good. It's not a site that is all (((((huggggggzzzzzzzzzzzzzzzzzzzzzz)))) like it is here but you will hopefully get excellent advice.
I hope you're okay.
The Girl made it into the Zone cross country (basically the first interschool level of cross country competition for the best kids at running in their school comp). She came 120th out of 190 for her age group which was pretty good I thought. She's gutted, hated today.
In cooking news I made tarte au citron today. It's really good, even if I say so myself.0 -

Yep you are right, Aaron (not my son) is the singer, James (my son) came up with the concept, directed, edited and produced the video. Obviously he didn't film the Aussie clips but he told them what he wanted. We made it! When I went to secondary school at the end of every PE lesson we had a shower before getting change dback into uniform. DD claims that at her school they don't have showers and often don't even change for PE - too me this is Ewww. Was my experience unusual? (Yes they were naked communal showers but it was just what was expected so no one worried or got silly about it)I think....0
