Am I Entitled to Compensation for New Build House

  • All sounds a bit strange a new estate would have new drainage runs to service the new houses. Therefore the design team and or contractors have made the mistake.

    I might be missing the point but if it's a corner plot and the lounge is throughout the rear can they not just install the window on the side you want anyway looking onto the road rather than onto the side access path?

    How much is already built, there may be something they can do with a small negotiation with planning.
  • Hi thanks all for your input. The lounge is on the left of the house. The kitchen/diner is on the right of the house. As they will be putting kitchen units on the wall that's why I assume they have blocked out them windows. I still want the house but surely they must be able to offer some incentives at the least for this mis selling. What do you think?
  • Forgot to mention the build stage is that the roof is now on.
  • I think it's reasonable to say that you should expect the builders to try and negotiate down whatever you propose, so if I were you if you feel happy with it id start with the 4 things you suggested and expect to be talked out of one of the things. So pick wisely!

    I'm sorry but you’ve received lots of good advice on here about what you should do and what you might expect to receive. I’m not sure what else you hope to achieve by asking the same question.

    I don’t think anyone is going to come on here and tell you that yes of course you will get everything you want and that TW will throw in some extra discounts as well.
  • Hi I still want the house. My solicitor has said I need to tell her what I want from this so she can act on my behalf. I asked her what my options were and she said she has no idea as she has never dealt with something like this before. I hit the impression as it is the house builders recommended solicitors I feel they are siding with TW to an extent and not being too helpful.

    Options I am thinking:

    1. Get them to build the house as it should be - however my solicitor says they will probably not do this due to drainage etc

    2. Get them to take money off the sale price. Does anyone know what sort of % discount would be a sensible amount? I am purchasing the property for £253,000.

    3. Get some incentives thrown in:
    - flooring
    - stamp duty
    - legal fees
    - my option upgrades I have picked

    Not sure how much I can ask for and what sort of margins they have on these things.

    Any ideas folks on what would be a sensible amount to claim?

    If I went down the route of taking my deposit back what kind of amounts could I sue them for? I believe thc consumer code limits you to £15,000.

    With regards the consumer code I emailed them and they replied to say to give the builder an opportunity to put things right in the first instance.

    Any help would be much appreciated.

    The consumer code is an absolute waste of time and virtually never compensates adequately, so I'd forget that. Of course, you can bump on about it and state how they're not following it as they should, but ultimately they're not going to give a toss, as they know the code is toothless. They also know they'll sell the house no bother I'm guessing, so that weakens your position.

    What you could do is request a meeting with someone senior to state your case. If you can get that, don't moan about it but make clear your views on "why" this is not the house you had agreed to buy, and, that to continue with the process, they need to make you some sort of offer by way of goodwill. What that offer is I don't know and is for you to decide on what's acceptable.

    You need to get as much together as you can to argue your case, not with the sales person on site, but with someone more senior. State that you are willing to travel to speak with someone. Make some calls to head office and make yourself known to them.

    What have the local planning said about the apparent building of a property "not" as agreed on plans.? They surely have some influence in this matter, and personally, I'd be asking some serious questions as to what their view is and what can be done to enforce correct construction. This might at least give you some leverage over the builder to cough something up.

    Think carefully, gather all you can and go at it relentlessly. They aren't going to knock down what's been built, but you should be able to get something from them I'd have thought.

    From what has been described by the OP it is not a case of not been built to the plan but not built to the plan the OP saw. As in it was a generic layout of the house rather than the specific plot that she was shown.
  • Thanks all good ideas. The sales manager called me Wednesday but I missed her call. I tried calling her 3 times yesterday and left several voicemails but have had no reply today. I called her twice today too and again no answer or reply. My solicitor is also waiting to here from TW since Monday. I will try calling the sales manager tomorrow again and if I do not get a reply I will call head office. I think they will just tell me to take back my deposit and leave it but that's simply not good enough we are really hurt.
