Am I Entitled to Compensation for New Build House

    What you really need to do is go on the local authority planning portal and view the uploaded plans for your house type.

    I've just looked at our house on the local planning portal which to be fair was built by Bovis. But on the floor plan it does say "Plots xx, xx, xx AS ABOVE" "Plots xxx, xxx OPPOSITE". You need to see if this is the case for you. Because of it is described like that you do not really have a leg to stand on as you or your legal advisor will not have conducted full due diligence.
  • Hi so I have checked the planning portal of my local authority. Two planning applications were submitted for the site and both applications have the same plans for my house design. On the plans my plot and three others are listed with a title 'As Hand'. There is another plot which is listed with a title 'Opp Hand'. In total there are 4 plots with this house design on the site.

    Any advice on how this should be handled going forward would be much appreciated.

  • Hi everyone just wanted to see if anyone had any thoughts on this? The builder has aplogised to me and said this was done due a drainage issue. Not sure what I can do from a legal point of view now.

    The only legal recourse would be if the builder is in breach of contract, e.g. the contract clearly states you agreed to purchase a "MSE" type with the front entrance door on the left and the lounge on the right of the house.

    Do you want the house or not? If not, negotiate for the return of any deposits plus any quantifiable costs you have incurred. If the builder is in breach of contract and doesn't agree to this you can sue them.

    If you still do want the house either negotiate a fair discount or some extras
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

  • Hi I still want the house. My solicitor has said I need to tell her what I want from this so she can act on my behalf. I asked her what my options were and she said she has no idea as she has never dealt with something like this before. I hit the impression as it is the house builders recommended solicitors I feel they are siding with TW to an extent and not being too helpful.

    Options I am thinking:

    1. Get them to build the house as it should be - however my solicitor says they will probably not do this due to drainage etc

    2. Get them to take money off the sale price. Does anyone know what sort of % discount would be a sensible amount? I am purchasing the property for £253,000.

    3. Get some incentives thrown in:
    - flooring
    - stamp duty
    - legal fees
    - my option upgrades I have picked

    Not sure how much I can ask for and what sort of margins they have on these things.

    Any ideas folks on what would be a sensible amount to claim?

    If I went down the route of taking my deposit back what kind of amounts could I sue them for? I believe thc consumer code limits you to £15,000.

    With regards the consumer code I emailed them and they replied to say to give the builder an opportunity to put things right in the first instance.

    Any help would be much appreciated.

    Are there any disadvantages to the house being mirrored? If there were disadvantages then the compensation could be worth more.
