    This is a two bit amatuer operation run by a Muppet ex clamper called Terry Szmidt who has tried in the past to issue charges for not displaying a tax disc: :rotfl:

    Very dodgy then, sounds like they cannot get merchant facilities from their bank or other services.
    Paypal will open accounts for anyone until proven it is a scam.

    I would point out to Paypal about this operator and methods,

    Any serious query and Paypal will disable the account. The Paypal system is very tough on scams unlike
    the normal merchant facility you would get from your bank

    Complain by email to the BPA that it has been over 40 days since your appeal (show the BPA the proof of posting) and you have no other way of contacting the parking firm because they provide no email address. So you wish to complain that they have neither accepted the appeal nor provided a POPLA code within 35 days and will not be wasting money on more p&p to follow up by letter again.

    Insist that the BPA investigate if they say 'you should ask the parking firm'.

    Tell them again, if there was an email address you would follow up but you cannot and will not throw more stamps at this scam and the onus is not upon you as the consumer waiting for a POPLA code to have to chase it. And you certainly will not be phoning the payment line for a firm which appears unable to get merchant facilities from their bank and only offers Paypal as far as you can see.

  • Thanks for that post cm, today I received 3 appeal rejections.

    I think they are keeping an eye on this thread tbh!

    I'll post them later, they mention I said the signs are ambiguous etc but they say they are clear and visible... They state they also have a contract with the land owners and some other drivel.

    Mentions popla on it too.

    OK doke. POPLA are shocking at the moment, badly trained downright wrong, trashy clueless decisions from new Assessors coming out. Certainly not being seen to be fair to consumers, let alone understanding the POFA or keeper liability. It is frankly embarrassing.

    We need to address that in our updated advice on POPLA appeals and we'll do out utmost to help you win.

    I sent all 3 appeals on February 16th.

    My appeals were:

    Date 16/02/16


    Dear Sirs

    Re: PCN No. WA0451****


    I challenge this 'PCN' as keeper of the car and I will complain to the landowner about the matter if it is not cancelled.

    I believe that the signs were not seen/are ambiguous and the terms unclear to drivers before they park. Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as I believe the driver may well be eligible for cancellation.

    There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.

    I have kept proof of submission of this appeal and look forward to your reply.

    That is exactly 35 days from the day they sent their rejection letters (22/03/16)

    They seem to have said that I appealed 1 of the 3 a day before (15th) - I posted all of them at the same time!
