Yes, £60 if you pay in 14 days. £100 after.
x2.
The company (Capital Carpark Control) are so amateur im sure there is a way to beat them.
The PCN's are handwritten and terribly done, the first (if im correct) is over 56 days from getting the PCN to receiving the NTK so invalid? And the second looks like they may have misspelt the registration number.
I look forward to more replys
Thanks
James

So they are a BPA member and easily beaten with the 2 stage appeal ending with a win at POPLA for you. We know newbies are often amateurs at this, whcih is why I wrote the NEWBIES FAQS thread at the top of the forum, already linked by Raph-y.
Your first appeal is written for you there. POPLA appeals are shown in post #3 but that will be around March, if this lot reject the first appeal. Read the sticky thread carefully because you DO NOT talk about what hapened nor idenify nor imply who was driving so don't add anhything to the short (blue writing) template except, obviously, the registered keeper's name and address and the PCN number.
If the fake PCN offers appeal by email or online, do it that way and keep a screenshot.
When you say 'the second' looks like they've got the VRN wrong, do you mean you have NOT yet received a NTK for that one? If not and if the VRN was wrong, WAIT as regards that one. Don't appeal based on just a windscreen PCN with a wrong VRN of no NTK received for that one.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Oops, thought i edited those images *doh*
Thanks so much, i will check the stickys and get sending!
The second PCN is written by hand and the reg no looks like a V rather than the correct N on my plate. I did receive the NTK though.
Again, thank you so much.0 -
I can appeal online, i must tick a T&C box stating this though:
"I agree that by ticking the 'I agree' button above, I confirm that all the information I have provided is true and I understand any false information may be used against me in court. Should my appeal be rejected and I later refuse payment in the specified time allowed. I allow Capital Car Park Control to start issuing court proceedings against myself and the address I have provided. Capital Car Park Control is registered with the ICO and all information will be confidential in accordance with the Data Protection Act 1998. After filling the details click on the SUBMIT button."
Thats ok, right?0 -

Firstly, did the notice come to you in the post, meaning they have your details or was it a ticket on your car.
If only on your car, wait until you receive a letter from them
Best to post then, you simply cannot agree to those terms.

Hi beamerguy,
Yes, i got one PCN on November 16th and another PCN on January 5th.
Both NTK's came the same day (05/02/16)
Somebody (not here) advised me to ignore as any response can be take as an aknowledgement to their terms.
Im thinking about sending this, via the online appeals:
Date 08/02/16
Dear Sirs
Re: PCN No. WA0451**86
I challenge this 'PCN' as keeper of the car and I will complain to the landowner about the matter if it is not cancelled.
I believe that the signs were not seen/are ambiguous and the terms unclear to drivers before they park. Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as I believe the driver may well be eligible for cancellation.
There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.
I have kept proof of submission of this appeal and look forward to your reply.
Yours faithfully,
My name.
The online form also asks for address, email, phone number and to accept the T&C's ive posted above.0 -

For starters yes, but do it by post, you cannot agree to their terms and conditions, they are unfair0 -

Just a quick update...
I sent these appeals on Feb 10th and have no reply yet.
Is there a time window they need to reply in?
Thanks0 -

35 days. They may have given up on pursuing you. Try checking their website and go as to 'pay' your tickets and see if they are still 'live'. That can be a first indicator for you.
Come back after checking that for possible further advice. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
