PCN for BHX Airport

Hi folks,
We have just received a PCN from APCOA for Birmingham Airport from 3 weeks ago for stopping in a "no Stopping" zone (double red lines on the airport road).
I have searched for templates etc before posting this so sorry in advance if I missed anything.
I would be most grateful if anyone can advise how to respond to the PCN. Thank you!

Does the paperwork mention the Protection of Freedoms Act anywhere, or anything about holding the keeper liable for the charge?Je Suis Cecil.0

Hi, some reading for you
The scammers that infest some of the smaller airports are in cahoots with said airports as its is a (allegedly) mutual financial arrangement ....
Go back several years and you would have won this at a POPLA appeal ..... however in the world of PPC's they created another trade body (the IPC) that have a (again allegedly) kangaroo court :eek: (the IAS) The IAS seem to treat appeals as a lottery 80%+ loose irrespective of the evidence.......
you therefore can, after reading the below, do the first appeal (a new template appeal for the IPC is in the newbie thread) ,and then ignore .... or do the appeals as a paper trail.
VCS did try out their first small claims court case over such ....and as predict that they pulled out before the trial ..... . So far no IFAIK no PPC has tried placing this before a real judge! ..... I wounder why ?

This is why you need to answer the question about whether or not the notice mentions POFA.
Also please tell us date of contravention and date on the notice to keeper (not the date received.)
That will be a good start and will enable the right appeal letter to be sent.0 -

I have read, and re-read the document many times and can confirm the POFA is not mentioned, nor is keeper liability.
It says " As the driver and their current serviceable address (not sure what they mean by serviceable) is unknown to us, we request you either pay the outstanding amount or if you were not the driver, provide us with their details and current serviceable address and give this notice to them."
It mentions that the info was obtained through the DVLA/if the car was a hire car/threat to use debt collectors and increase the charges. it gives 28 days from the date of issue 15/01/16 to appeal.

just search the forum using Birmingham airport or Luton airport and apcoa , so words like birmingham apcoa (in the forum search box) and do the same as they have done, there are dozens of previous threads about apcoa and these 2 airports
also read and follow that newbies sticky thread
DO NOT GIVE AWAY WHO WAS DRIVING, this is most important due to POFA2012 helping the keeper
just use the BPA template, appeal, get the popla code, then draft up your popla appeal based on recent previous examples (of which there are several)0 -

the first point of call is the BPA appeal in post #1 of the newbies sticky thread
you can add that last point to the appeal but use words that DO NOT give away who was driving, so be very careful what you add to it , the land is not relevant for POFA2012 so as keeper you are really saying , "go away and chase the driver as POFA2012 does not apply , or give me a popla code so popla can cancel it on the same basis"0
