dealer repaired and serviced px car then I had it back

    jees some people..

    They have a car with £18K (presumably new) and they want to sell it to buy a £40K car. Then scoff at a dealer trying to "rip them off" doing a very expensive paint correction and service which could easily come to that cost.

    Remember, for every bad business out there, there are thousands of moaning chancers like the op.

    I hope one day he has a business of his own to run and customers treat him as pathetically as he's been with the dealer

    no common sense. I suppose had he lost his job after getting the car, he wuld have driven to the dealer after driving the car for a month asking the dealer to take it back and give a full refund

    To the OP, you have to some extent got off lightly, because it is you that is breaching contract. So you have to be reasonable. There is no way around the paint job, and you stand to gain from that. You could look at your 3 year service plan, divide what you paid by 3 and ask for that as a discount from the £750. It won't be much.

    I've dealt with the Audi dealer in Swansea before (I live in Port Talbot myself) and dealt with the Dealer Principal there. He tried to sell me a Q3 that had been speccd up to S-Line equipment without being S-Line and wanted to charge me £4k more than a price I had worked out on Audi's configurator for an actual S-Line that I'd speccd up a bit more. So I wouldn't be too sympathetic with them, but be realistic about what you can achieve.

    Asking for a third of the amount you paid for the service plan would not be an unreasonable request in the circumstances. Whether you are really entitled to it is another matter, but nothing for not asking. I think it would be unreasonable to question the paint job. It would have needed doing and perhaps Trainers, BMW main dealers in Swansea had taken off more from the car than they thought reasonable so decided to do the paint job.

    Whether it's due or not is irrelevant! It's their car to do as they please! If you want to breach the contract they should be paid their costs... Yes you have incurred them costs!

    why should you be the one to come out of this in a better position than before?????

    To summarise -- I don't think the dealer is being unreasonable, given the circumstances. He has done a fair bit of work and he is also being very good about cancelling your order without fuss.

    Sympathies for a very difficult time for you. Get your repaired and serviced car back and keep the money as you will need it.

    How much was this car if it was £40k debt + part funded by the policy + £18500px.

    the error was not getting a cash price and a PX price when you sold them the car.

    If they had already moved it on they could have made up a price(within reason)

    When you went to get it back where was it?
