dealer repaired and serviced px car then I had it back

I'll try and explain this as quickly and to the point as I can. I decided to order a new car in December 2015 for delivery in March 2016. The dealer gave me a px allowance of £18500 for my car and took a deposit of £500 also. It was a main Audi dealership local to me. There was a large scratch down one side covering 3 panels and he based the px price which took into consideration this. the service was not due for another 4000 miles also.
Skip forward to Monday this week when Tata announced 750 job losses in Port Talbot where I work.
I obviously cannot take on a debt of £40k in those circumstances and I cancelled the new car. I had my £500 deposit back and luckily the car as they had not sold it as of yet. They prepped the car for them to sell it which was repairing the paint and a service, which it did not need. They are charging me £750 for the privilege of this, none of it I knew about or agreed to before hand. The first I knew of it was when I went to collect the car and was told about ir.

Where exactly do I stand in this situation I really cannot afford the £750 that they want.

  • You gave them your car and your new ones not due until March?

    As you cancelled the contract they are entitled to recover reasonable loses from you. Prepping and servicing the car is not unreasonable before sale. Had you been buying it you'd want it done first.
  • To be honest, I think you've done alright out of the deal, and it seems only fair you compensate the dealer for the work they've done. They've done you a massive favour allowing you to cancel a 40grand deal without penalty anyway.

    The car had not been confirmed or allocated a build date, it was only on paper at the moment. I did allow them to keep it to maximize the px value. There really is no loss to the dealer only going through the spec and placing the order via computer. I just wanted to see the views of others and if there were a way of challenging it.

    So service and paint is free in your neck of the woods?

    Sorry to hear about your job.
    My guess would be that any receipts or written agreements that have given you - it should all be written in there. If it isn't listed about work carried out then they can't really charge you in my view of it.
    They can't take money you haven't got! The least they can do is offer a low repayment plan if it is listed in the agreement.
    I'm sure work shouldn't be carried out until the cooling off period is over too?

    Presumably they didn't know you were going to cancel the contract, so didn't feel they needed to inform you of anything. Yet you make it sound like they are trying to rip you off. They aren't. As Beenthroughitall says, they are doing you a big favour. The closure will hit them hard, too. I don't know what car you have, but it sounds quite expensive. Three panels resprayed to retail standard and a full service for £750? Sounds like a bargain to me. Take your newly-repaired and serviced car, pay them the money and drive away, being thankful that you still have a car, and they haven't slapped a big penalty clause on you for cancelling.
    If someone is nice to you but rude to the waiter, they are not a nice person.

    My reading of the OP is that he gave them the car to prep for sale and thought he would never see it again. I can't see that the garage has done anything unreasonable here. Far from it - they even returned his deposit.


    Should also have said I am sorry about the job loss too. Been there, done that, it's no fun at all.
    If someone is nice to you but rude to the waiter, they are not a nice person.

    I did not expect them to paint the car or service it. The service was not due for another 4000 miles and I was told that they would pass on the car in it's present state. At no time was I informed that any work was being done on the car!

    Also when I originally purchased the car I paid extra for a 3 year service contract.

    Perhaps you could do a deal for a cheaper car from them, let them keep yours and give you some cash back too?
