i didnt activate windows, it was preloaded and installed, without me doing the usual activation/geographic/name etc. i don't know if this is usual with window 10 or not - but the username is cube, so it has been pre-setup
i'm not sure how i could establish the functioning without taking it out of the box?0 -

Taking it out of the box is somewhat different to installing Skype and Chrome - you mentioned that in post#7.
Anyway, I'm only pointing out the law to you.0 -
yeah, that is true. I feel silly for waiting to see if the screen improved, and installing programs on it.
i didn't realise that would effect anything.
It says that you cannot return a used computer - does this mean i cannot even return it?0 -

I've been looking at the website for returns and it says:
"The item must not be used and must be 'as new' when returned to us. If the item does not include the original packaging a charge may be made. We reserve the right to make a minimum charge of £50 to restore a used computer back to factory default settings. Please note you cannot return a used computer to us under the Consumer Contract Regulations."
Would the laptop be considered used at this point?
I've used it for a total of maybe an hour, and installed skype and chrome on it, and done nothing else
Yes, that will be your sticking point. I think you'll need to prove its faulty or doesn't conform the the description as advertised.
If it's simply a case of its not as good as you thought it should be then you may have a problem by using it.
Do you have a local independent computer shop that could give you an unbiased opinion?0 -
That is not right.findingrights wrote: »It says that you cannot return a used computer - does this mean i cannot even return it?
You can certainly return the computer - but the seller can deduct an amount equal to "the diminished value" of the goods.
That does depend on the seller having supplied the appropriate documentation at the time of the sale or with the delivered goods.0 -
i have now emailed the seller informing them of my issue, and will update on any replies. That is not right.

what appropriate documentation is that, sorry to be naive0 -

For example, if the seller has not informed you by a durable means - information on a website is not durable, but an email or piece of paper is - that they can recover the cost of that 'diminished value', then they must refund the full amount paid.
For example, if the seller has not informed you by a durable means that the consumer must pay the cost of return, then the seller must bear that cost.
There are many other things they must tell you.
It's not easy reading, but they are all listed in Schedule 2 of The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Check emails, delivery notes, etc.0 -
No, this is only for change of mind returns.findingrights wrote: »on the returns part of the website it says

If i am entitled to a full refund, do i still have to pay the 'minimum £50 restore cost"
and does it matter that i have turned it on and used it0 -
