order sofa from scs new years day

hey guys i just need abit help/advice its my own fault i hold my hands up to this but, on new years day me and my partner went too scs to look for a new sofa because our current one is too low with me being in a wheelchair.

so before we went we had a look online and thought only we go down the interest free for 4 years finance route with a repayment of £40-50 max, so we get to the shops and a young ladie comes to us and asks if she can be of assistance too which i reply yes we looking for a corner sofa that is high enough for me too comfortably transfer from wheelchair to couch and back can't be fabric due to having 3 year old son and dog that would destroy it, so after 30 minutes we see a couch we really like we design the couch too how we would like it.

we goto the computer to apply for credit and it is accepted and signed for we shake hands say our thanks and leave, when outside in the car i thought to myself i wonder how much that sofa was to buy out right as i never looked the answer being £4600 im not the best at math but i work that out at around £94 a month over 48 month which is almost double my max i told the sales assistant i had to spend, so i returned home feeling a bit annoyed and ring up the store of purchase and ask to cancel my order in which the man on the phone tells me i cant as it has been sent to manufacturer to be made bare in mind this is new years day, to which i replied i have left your shop less than a hour ago its new years day and the order has already been sent to lazyboy too which he replies yes, so i proceed to ask about my rights too cancel which he explains to me i have no rights to cancel and that should of been explained to me by the sales assistance before the sale was finalised which it was not.

i then ask him what i can do he tells me i have upto 7 days to make amends to the sofa of chosen or 14 days to cancel my finance agreement with creations, so i reply so if i cancel finance then no one is paying for sofa so lazyboy will not make it correct? no he replies you will have too pay out right at this point i get really annoyed say some unkind words and hang up the phone.

but now i am thinking if i cancel the finance and dont pay for sofa will if still be made and how will that effect my credit rating? as i said i know it is my own fault i was gullible enough to sign a agreement without checking total prices.


oh and before i forget the is a 14-16 week wait for this sofa so i also got too live with a sofa i can no longer use for 14-16 weeks.

    Does the document you signed not detail the repayments?

    You don't have any rights to cancel the order. You do have the right to cancel the credit agreement but you will still be liable for the cost of the sofa.

    My advice would be to call or visit the store and ask to speak to a manager. Remain polite and calm, and hope that they are not aware of your previous "unkind words".

    You can't cancel, you entered the premises of your own free will (wasn't door to door or a cold call) and told them you wanted "that" sofa in that colour and that configuration and signed a contract for it.

    Now you can ask if you can change your order to something more affordable and you may find the store more willing to do this as they wont be losing any business then to buyers remorse.

    i am also thinking at no point did the sales lady check my id and she took my bank details by mouth as i did not have my card on me so would that help in anyway

    yes it did but they was not pointed out to me i did not ask to see as i told her my prices and i just looked at the sign line

    It's your responsibility to check paperwork before you sign it, especially one that is legally binding.

    You can hope for some goodwill from SCS, but you have no legal right to cancel the order. Cross your fingers though that your previous 'unkind words' haven't destroyed any chance of this.

    When you talk to them, be calm and polite. Maybe even apologise if they mention your previous phone call. Remember that they are in no way obliged to give in to you though. As suggested above, asking to change the sofa rather than cancel it may result in a better outcome.

    If they had any goodwill before, they certainly won't now - if it's anything like where I've worked, all calls are documented including any abuse.

    Next time think about how you would feel if you were on a low wage, working New Year's Day and being sworn at for something that isn't your fault.

    They are wrong to tell you that you cant cancel.

    You can - just not without potentially being liable for losses they incur due to your breach of contract. They do however have a statutory duty to mitigate their losses - by cancelling the order with the manufacturer (although I don't believe they'll have sent it through already - more likely are just telling you that as it sounds better than "no we haven't sent it but far too many people have buyers remorse after purchasing our overpriced crap and we don't want them to cancel") - and 1 hour after ordering, they'd be hard pressed to justify any costs except perhaps a small admin fee.

    Another option may be possible though. You say its nearly double what you told the sales rep you could afford? If so, I'd try emailing them and saying that you called 1 hour after ordering to cancel as you read through the documents when you got home and have realised that you have been missold. That you told the sales rep you could only afford x a month but he has signed you up to an agreement costing x per month.

    No, that will not help you in any way.

    When you enter into an agreement it is up to you to read what you are signing.

    You need to stop trying to blame other people and take some responsibility for your own choices.
