    plus this was an entrance to the doubletree hotel so surely that is their property and not the airport?

    Do the photos clearly show that she was on the Doubletree land? Was it a static ANPR or one of these little cars? If it was static, then does it appear to be on the airport road or the Doubletree road?

  • if its bylaw, its a police matter under common law as bylaws are common law offences.
    Has nothing to do with any private company.
    Land covered by bylaws is not relevant land for POFA 2013 as far as I know so no keeper liability exists.

    the photos clearly show her stopped in the entrance to doubletree hotel, can even see on the photo the side of the hotel wall and the sign showing hourly parking charges once you pass through the barrier - this is all visible on google maps! as far as i can see this is hotel land not airport but thats an assumption!

    its a static ANPR showing clearly in the hotel entrance drive...

    very interesting point on the byelaws will add that to my appeal letter :beer:
  • What time are they claiming the car spent there.
    As they are offering a contractual service, you first have to read that contract and then decide to park by accepting the offer or drive off, which you did.
    What passengers did is not relevant to the contractual offer.

    Supreme court has ruled that parking charge contracts are "genuine offers" so that offers a better defence in contract law as now you have to read the offer and accept or decline it.

    I bet a judge would find that point interesting, at which point is a the genuine offer accepted.
    The supreme court said when you read the signs and park up and leave the car.
    So by that they also must mean if you read the offer and decline it, you have no contract.
    They can have one or the other but not both.

  • there are 2 photos, 20 seconds between them. photo 1 shows my wife stood outside the car, photo 2 is her dad stood outside the car. she was there for no more than 30 seconds as only had hand luggage!

    It's all pointless as they are now with the IPC, so there will be no point continuing with the appeal to IAS. So don't bust a gut trying to perfect an appeal as it will go nowhere. I like salmosalaris' latest suggestion here for IPC firms:

    But do not then bother with IAS.

    JUST first appeal, just to make the points shown, then ignore them unless they try a small claim, in which case it's defendable.
