Two parking tickets for NPE
Comments
-
Hello good people, just another update on the situation. I received another further threatening letter from DRP regarding the PCN. I still intend not to pay as I feel at least one of the two tickets they want me to pay for is unfair and unjust. I would be lying if I said I wasn't worried about the possibility of court action, largely because I don't want a £340 fine to ballon to something in the £1000s with court and lawyer fees. I also read up on the beavis v parking eye court case and it does seem like the courts aren't massively in favour of the victims of these lowly people.
My question really is would this likely go to court and if so how sensible are judges in this matter because anybody thinking logically would realise these PCNs are largely unjust and corrupt. Also could the court fees ballon to an eye watering level ?
Thank again for your help guys, not sure were I would be without you, probably £340 poorer.0 -
Small claim costs are capped to £50 legal fees + £25 filing fee. If it ever got to court (that's still just bluster) you can offer to settle for a much lower figure, but if defended properly you should be able to beat them (and claim your costs back too).0

you are overthinking , is not £340 , the tickets are (if enforced in court) £200
even parking eye would struggle to claim solisitors cost going into the thousands
hint:
small claims court
hint 2: max solicitors costs capped at about £50 .

Carry on Ignoring DR+ they are Muppets, Court is a bit of a lottery, but I think you are over egging it thinking it's about high costs and lawyers!0

You need to do a bit more research on the small claims court.
If the case is lost by you, costs awarded are capped at very low levels, typically a MCOL filing fee of £35 for claims £300 - £500, £50 solicitor charge plus any travel costs of claimant. This would be on top of the original PCN charge, so if the original charge was £100 (x2) you'd be looking at around £300. Less than they're trying to screw from you now!
But this is getting a bit silly now, you're asking the same question about whether this will go to court and we've told you that NPE have no record of taking anyone to court. If they had court in mind for you, they wouldn't be p*ssing around with debt collectors. Read the newbies FAQ sticky, post #4 about debt collectors!
I've given you this link before - have you read it?

Can I suggest that when the OP comes back about the next debt collector letter, we all just avoid replying? Maybe then OP will understand the message.0

Hello everyone sorry for the late reply currently on night shifts.
Sorry guys, I think my posts are getting as tedious as those letters from DRP. Please accept my apologies for my repeated posts, I would like to say however your help in this matter has been greatly appreciated and reassuring in what is proving an increasingly draining issue. I will do some more research into small claims courts and surrounding issues once I finish my nights. Otherwise I will save any further posts to only if things progress in an unintended way or if I end up in court.
Cheers again everyone, you are the real heros of our society !0 -
i hope you didn't pay these cowboys !!0
