    Oh dear, I've just re-read this thread! There's some confusion with the dates - I don't think the original dates quoted are the ones I based my advice on to press for POPLA. It now seems that they may be December, not November, in which case POPLA is no longer in play.

    Doc, can you please confirm which - very important.

    PS - do you prescribe drug volumes? :eek: :rotfl:

    Umkomaas, the dates of the PCN were on the 03/12/15 and 09/12/15. I fear this is not good news :mad: ?

    Hello everyone, hope are well. So NPE have got back to me and no surprises they have rejected my appeal. Just so frustrated with this situation and knackered from work so tempted to just pay it. Do you guys feel I should fight for this ? I really don't want this going to court or requiring bailiffs and the sort.

    How should I go about pursing this further ?

    This is what they emailed me saying by the way:
    Dear Mr x



    As you are well aware of the parking restrictions in this area, you are advised that it is your responsibility to ensure your permit is valid.



    You are also advised that the signage within this parking area advises that parking charges may be issued remotely from images taken of vehicles parking outside the advertised terms and conditions.



    As you have previously been made aware from failed appeals of the parking restrictions, we are unable to log or consider your appeals on this occasions.

    why would it involve bailiffs ?

    in order to get to bailiffs the following would happen first

    they take you to small claims court
    you lose
    you have 28 days to pay the judgment
    you fail to pay the judgment
    a CCJ is issued (or asked for - not sure)
    the court order is enforced
    bailiffs are tasked to enforce it

    paying the judgment before 28 days are up means its never enforced , no CCJ and no bailiffs

    Which QEH was this. The one in King's Lynn was County Parking. Is this a different one.

    According to https://www.knowyourparkingrights.org.uk they are now called National Parking Enforcement. There is this article about them

    Oh i understand I am not too familar with how this process works completely. So would the small courts judgement fee be more than that of the tickets, if so then maybe I should cut my losses ?

    And this is the QEH in Kings Lynn, Norfolk. Thank you for the links will give it a read.

    To get any money in the small claims court, they would have to first go to court, and in 2014 this tinpot outfit filed zero claims (this could always change, and 2015 figures are not available)

    If you lose in small claims, it will be another £100 or so, but this lot use Gladstones; it appears from The Prankster's blogs they are a right bunch of amateurs and could not find a court win if it hit them in a face with a barn door.

    No known report exists of Gladstones winning against a well-defence case

    I would reply

    Dear PPC,

    The debt is denied. The correct permit was purchased but a clerical error meant the dates were wrong. My contract for parking is with the permit issuer and not yourself, and therefore no debt exists to yourself. Please contact the permit issuer for more information.

    I reject your offer to use the IAS. They have been exposed as a kangaroo court who offer a service provably biased towards operators. However, I am willing to attempt ADR to resolve the issue and suggest the Consumer Ombudsman as a suitable service.


    Please note that practice directions allow that the court may impose sanctions against you should you ignore my offer to use ADR or unreasonably refuse it.

    If the accommodation secretary made a mistake, then working on the assumption that she was employed by or was an agent of the management that brought in the PPC, can you not get her to confirm, on the proper headed notepaper, that it was NOT your error and that the tickets should be cancelled?

    That seems the best way forward.
