Two parking tickets for NPE

    Thank you very much hoohoo for the drafted email, I have now sent an email through to NPE and await their reply.

    With regards to contacting the accommodation, I have already tired this but I have noticed some very fishy behaviour, namely the receptionist knows the parking attendant well and mentioned she can do nothing about an issued ticket. Which is funny as a colleague of mine later found out during a separate conversation with her that she in fact has the ability to cancel tickets. She will accept no responsibility regarding this matter and is stubbornly refusing to do anything for me. I understandably gave her a piece of my mind which didn't sit well with her and this has definitely blown my chances of her doing anything for me, not that she would anyways. I know from NPE's website T&Cs that the cut of the fine goes to the accommodation so perhaps that has part to play.

    Either way lets see how this plays out, all your advice is much appreciated, I feel well supported :beer:

    Hi everyone so NPE have got back to me regarding my appeal

    this was me:
    Dear Appeals team

    I have reviewed all evidence provided by yourself and given the clerical failures and your less than fair practices I intend to further appeal this matter.

    The debt is denied. The correct permit was purchased but a clerical error meant the dates were wrong. My contract for parking is with the permit issuer and not yourself, and therefore no debt exists to yourself. Please contact the permit issuer for more information.

    I preemptively reject your offer to use the IAS. They have been exposed as a kangaroo court who offer a service provably biased towards operators. However, I am willing to attempt ADR to resolve the issue and suggest the Consumer Ombudsman as a suitable service.

    Please note that practice directions allow that the court may impose sanctions against you should you ignore my offer to use ADR or unreasonably refuse it.

    they replied:
    Dear Mr x

    Please be advised that to use ADR you will need to contact IPC.

    As stated, the permit was not valid and therefore you were correctly issued a parking charge. Our contract is with the landowner to issue parking charges for such.

    If there was a clerical issue with the permit, you need to the issuer as only they have the ability to have the charge cancelled.

    TELL the accommodation secretary to advise you of her holiday dates , as she will be required in court to give evidence.

    I contacted her again today, this time I even compromised in asking if she could just cancel one of the two tickets and this was her reply

    I am very sorry but I cannot cancel the ticket and the fines will stand.
    It is your responsibility to make sure you are parked correctly and are showing a valid permit.
    With your car parked in that bay we were unable to book this bay out to new guests, so lost revenue from it.

    The excuse about lost revenue is absolute crap because if that was a concern one would imagine she would have contact me to say "Mr x your permit has expired please renew or move your car to accommodate a paying customer", besides there were plenty of spaces in the car park. Either way a combined fine of £120 is disproportionate to their "lost revenue" of £10. I have given up hope with her, I have contacted her manager but I expect similar success with him too.

    Either way could someone kindly suggest my next move, do I go ahead and appeal with IPC even though they will likely reject my appeal or should I just ignore them ?

    The lack of understanding and discretion afforded to me by the parties involved makes me even more determined to fight this, not even about the money anymore !

    if she really said the word FINES then she is really behind the times as you cannot be fined

    as for appealing to the IAS , some say yes, others say no , coupon-mad , myself and prankster say no, because we feel the only form of ADR you should accept is a fair one, like the Ombudsman Service

    others on here like MR DEEP say use the IAS and get a stupid decision you can use as a defence in court

    the decision has to be yours, not ours , because both schools of thought are valid

    and there is the school of thought that says IGNORE anything from now on except genuine court papers from the PPC or landowner

    I urge you to put in a high level complain as per post #11 reminding them of Jeremy Hunts autumn 2014 statement making the trust jointly liable for the actions of its contractors and get your MP involved too

    and sign the Beavis petition if you have not done so already

    Step away, collect any letters. NPE are not known for court, you will get debt collector letters. So what really?!

    Thanks for the reply.

    So all things considered I think Im going to go with a reply back to them stating I would like to appeal further with the Ombudsman Service or another neutral appealing body. Then I will avoid further contact with them. If they send court papers then I guess I am going to have to cross that bridge at the time, I just don't want bailiffs and the sort disturbing my family home.

    I intend to put in a high level complaint but I have not been able to find Jeremy Hunt's autumn 2014 statement regarding the being trust jointly liable for the actions of its contractors. Can anyone kindly direct me to it please ?

    I have signed the Beavis petition, how has this not gotten 10,000 sign ups yet !

    You don't get bailiffs in the scenario you describe. A small claim has to be lost first by you (or ignored) and then on top of losing, you would have to refuse to pay after judgment. Not going to happen, is it?!

    But keep all the letters in case you need them in the next 6 years to defend it.

    Jeremy Hunt's statement is in newspapers so just Google it but I don't recall him saying the Trust is liable for the actions of its contractors (he may have done of course). I recall him saying that such fines were unacceptable against NHS patients and visitors.

    Try Googling 'Independent Hospitals NHS fines parking' because I recall an Independent article quoting him.
