Parking fine issued for a disabled person being in disabled bay!

Hi all,

Today Ive recieved a parking ticket issued by Horizon for being in a disabled bay at my local Tescos, there are two photos one showing the back of the car the other showing side view from the back, my dad was actually sitting in the car at the time with the engine running, in one of the photos you can see the radio light was on due to my dad sitting in the car waiting for me, but no one came up to my dad asking for any evidence of disability, I am registered disabled & my car is a motability car, Ive sent off evidence that my car is motability disabled car & that im disabled, there was no closer bay available so my dad wernt into the bay as im disabled, I asked to appeal due to the fact that I am disabled & the car is also registered disabled, but they have emailed me back to say they now need evidence of my blue badge, which I dont have we have had the car for 6 months & with everything going on i havent got around to applying for it but thought if my car is motability I could park there, I really dont have £40 to pay the fine, & if its not paid within a week the fine goes up to £70, I think it so unfair & I know tonight Im going to be unable to sleep due to worry, please can anyone advice me on what i can do, many thanks for your help, just dont know what to do next :(

    I had a run in with Horizon issuing a false ticket with a false statement, something I have passed to the DVLA.
    This was in a Tesco Express. Horizon failed to placate me and then send a reminder with their pathetic threats.

    I contacted the CEO of Tesco's by email and received an email from
    Jason Walczuk
    Customer Service Executive To The Main Board

    ceo.customerservice@tesco.co.uk

    Within 48 hours the ticket was cancelled. Tell Jason what is happening to you. He comes across as a normal decent chap and I think Tesco are fed up with Horizon

    Why are you asking?

    If you get an answer what difference does it make to the situation?

    Blue badges are irrelevant as far as private car parks are concerned.

    Blue Badges have no meaning/validity in private car parking. Its the Equality Act that matters, regardless of any badge.

    How many times do I have to say that there are two different legal matters here? In essence, a PPC can dictate what terms it wants - only yellow cars can park in certain spaces or cars with 4 doors only and, if you park in contravention, then they can pursue you in court on that issue.

    You on the other hand can start an action against a landowner for not providing unconditional spaces for disabled drivers (i.e. no Blue Badge should be necessary)

    But the two issues are not offset and it is quite possible for a PPC to win in court for you not displaying a Blue Badge and also for someone to win in court on the Equality legislation, the example I have quoted before is a visiting disabled Grandmother form Europe being racially discriminated against as Blue Badges are not issued in their country.

    So, unless the store intervenes, then the PPC has an unhindered path to court if they so wish. I believe that the previous POPLA chief adjudicator had some reference to this in his annual report but that is no longer on line.

    The board is friendly - but honest as well as this will serve you best. There is no sense in telling you what you want to hear if that is wrong.

    You constantly have been politely told after posting poor advice

    You never have corrected your advice, so no wonder people have got frustrated and used stronger language (though no-one has been rude to you as you have alleged)

    (And where do you see any unfriendliness to missbiggles (who actually asked the OP a clearly provocative (and unneccessary) question she already knew the answer to)
