Parking fine issued for a disabled person being in disabled bay!

    `Gosh, what a friendly board!

    What was your intention by asking your question (bearing in mind you didn't really want it answered as you already knew the answer)?

    If you want friends don't ask such a pointless and provocative question on a serious forum.

    No-one has been unfriendly to you anyway (though your post doesn't seem couched in a friendly way!)

    Things may seem a little unfriendly at times, but in reality its just blunt and to the point the main aim here is to prevent people paying some of the ridiculous trumped up charges levied by Parasitic parking companies (PPCs)
    When it comes to blue badges on private land and disabilities the key thing is something called the Equalities act, and the sections of that act previously covered by the Disability Discrimination Act (DDA) .
    A blue badge only tells part of a story and not everyone has a blue badge.
    The important thing is that the landowner makes reasonable adjustments to cater for someones long term disability, whether or not that person has a blue badge or not.
    This could be anything from assisted parking ( people directing disabled people to suitable spaces) assistance with getting shopping to a vehicle for transportation home, giving disabled people extra time to park ( without them having to beg for it from a non plussed CS desk ) or the more usual and less labour intensive disabled bays.

    Theres nothing wrong with parking in a disabled bay without a blue badge in a private car park as long as the driver has good reason to do so - ie is disabled, or the bay is poorly signed/marked/covered in snow.

    Parent and child bays are just a gimmick that only serve to devalue disabled provision and give people a false sense of entitlement ( ie I parked in a disabled bay as there were no Parent and child bays/parent and child bays were full )

    As previously mentioned things may seem rude at times, but the messages are usually to the point, if not a little blunt sometimes.

    As for your issue I would recommend taking it up with the store manager, ( or the email address above) as soon as he/she is aware they should/must call off the parking company. In almost all cases the PPC is acting as agent for and on behalf of the landowner ( ie the supermarket) and as principal the landowner is equally responsible and liable for the actions of its agent.

    Yes the main aim, yours and mine is to stop this vermin ripping people off. When a newbie arrives here it's like they have hit WW3, How can a newbie accept such a forum can do this with what they read.

    As you say, the OP just needs to contact Tesco's, last thing Tesco's need is lost customers and the disabled being penalised, so simple, it will work, so why the nit picking, it does not give this site a good reputation

    Thank You all for your kind posts & to Beamerguy for the email address, I have just been to my local Tesco with my evidence of my car being registered disabled & documents & the letter of the fine, Ive spoken to the manager who has taken a copy of all the evidence given & will give it to the person who can deal with the issue when hes on his next shift to see what can be done, but they were very sympathetic with my case & apologetic, I was also told they bought in Horizon due to the number of taxis & cabs that were taking up the customer car spaces as the Tescos is very near to Gatwick & the taxis could get to airport customers very quickly from there & action needed taking against these, but innocent person like myself are being affected, if this issue isnt sorted in the best way I will contact the above email address & complain to Jason Wulczuk, I am a disabled person in a motability car in a disabled bay, we have been parking in the disabled bay for the past 6 months with no issues & cant see why I cant park in the Tescos private car park when shopping in my local store, thanks again for the kind posts, will update as soon as I here anything x

    Not where a term is in itself illegal and EHRC have longsince ruled that asking for a BB to be displayed on private land is in itself illegal discrimination. The ruling for England and Wales is on this board and I hold a similar one for Scotland - Although admittedly they were unwilling to get involved in a test case to give teeth to their ruling. They were willing to give evidence but asked that some other org or individual do the hard work instead.

    Also remember that Tesco have revised the signage at some of their stores to reflect the Equality Act better, so someone else must be having concerns?

    Its perfectly friendly - but remember that poor advice can cost individuals dearly and that we do get trolled by the PPCs themselves on a regular basis - often trying to mislead or trawl for personal info to use against people.

    So for those reasons, misleading/inaccurate info tends to get jumped-on. Its nothing personal. :)
