Passenger Whiplash Claim Advice

Have you even been to A&E / your GP? or was the first thought £££?

The OP has 3 years to claim. Injuries can take a while to manifest themselves so I never understand the indecent haste with which claims are made and settled. The OP might get a pre-medical offer from his mate's insurer. No need for any medical or probing questions in an effort to avoid the inevitable solicitor, doctor and physio costs.

A visit to the GP might add a bit of weight but it really isn't necessary.

The PI Solicitor will hook the OP up with a friendly medic who knows exactly what (leading) questions to ask, mainly because it's in the medics interest to help with successful claims, otherwise his lucrative source of income dries up.

Anyway, Christmas is an expensive time of year so a little extra cash will come in handy. A 30mph impact is pretty severe and as we all know the OP has a incontrovertible right for compensation.
Mr Straw described whiplash as "not so much an injury, more a profitable invention of the human imagination—undiagnosable except by third-rate doctors in the pay of the claims management companies or personal injury lawyers"

  • For an update for those interested, I went to my GP who has reinforced that I do indeed have moderate whiplash. I did not expect those on an ADVICE forum to be so judgemental and horrible to a victim of a road accident.

I have not gone towards making a claim, I was actually seeking advice for when that time came around, if the situation warranted it.
  • Dude, ignore those shouting the odds about how repugnant making a claim is and do what is right for you.

The law says if you suffer injury as a result of someone's negligence, you are entitled to be correctly compensated.

Certainly in my experience, people are often quick to spout off about such situations, yet would happily have a slice of the action if they were in your shoes and if they don't then fair enough, that's their decision.

The insurance industry have done a good job with their massively funded PR campaigns and political party donations to attach a stigma to anyone with the cheek to make a compensation claim. Yet when they achieve their goal, premiums will broadly be the same and shareholders dividends will be up and justice will be long gone.

If your first post had been along these lines, having visited your GP and diagnosed with some soft tissue damage, "what do I do next?" you might have a had a little more sympathy.

Moderate whiplash, you'll hopefully get over it very quickly.

Whiplash is a gravy train and open to abuse and fraud. Fine to get compensation if you have a truly diagnosable injury and your life is adversely affected.

Someone rear-ended me our hire car whilst on holiday earlier this year. Stiff neck for less than a day. No need for either me of the wife to claim but as you know insurers pay out for far less.

No-one is forced to claim. It was your decision not to pursue a claim, even though you were perfectly entitled to. (You are quite wrong to say compensation is only intended for life changing injuries)

But crowing because you chose not to on a thread where the OP clearly does want to and came for advice on how to go about it is a bit like old Smashy continually telling us he does a lot for charidee.
  • Forced?
    "wrong to say..."?
    Crowing???

You must be listening to alien voices in your head, or made the mistake of a post-pub post.
