So once it's put in the shop its second hand then?
Yes if it's unboxed, assembled, with a sewing machine fitted then used in demonstrations over a period of months. A few of them had corners crushed, we called them Weetabix cabinets.
I also consider any product that is unboxed and put on display to be secondhand.0 -

In other words it was just your opinion, I don't have to prove anything I am not the one making sweeping statements as though I am an authority or expert about retailers selling second hand items without being able to back them up.
Do you honestly think that shops never resell goods that are returned when they are not perfect, It has happened to me many times. I'm amazed I didn't think people were so naive.0 -
It may happen occasionally and mostly by an honest mistake but where is the evidence that 'companies do this all the time' as you stated in your post, you make it sound that the majority do this when you have nothing to back this up, it is just your opinion, we all have opinions but without anything to prove them that does not mean they are correct.0

I'm not making out the majority do it all, but it does happen a lot, some companies have been prosecuted for it. I can't prove it but I have had personal experience. You need to examine products you buy more closely. So that doesn't make it my opinion it makes it fact.
Mistakes shouldn't happen, more care should be taken.0 -

Care to tell me which law they would be breaking by selling goods which had been worn/tried on by someone else?

Unfortunately the thread has gone further than the OP's problem, but if the goods were more than just tried on they could be prosecuted for selling goods not as described.
I'm sure you mentioned once that you were married to a lawyer so ask him, he will certainly be able to tell you better than me.0 -

Nope, not married to a lawyer.
Not sure how they can be prosecuted for selling goods that aren't as described - given I've never seen any shop describing anything they sell as "brand new, unused & unworn"
Now a consumer may have a right to a repair/replacement/refund/price reduction if the goods didn't match their description or failed to meet a standard regarded as satisfactory by a reasonable person, but that doesn't equate to a criminal prosecution for the retailer.You keep using that word.
