    Well in that case it is clearer you are still entitled to nothing but a refund.

    Also, a much more unlikely scenario is that the item has been advertised as 'new' in a physical store prior to the online sale...Maybe someone/a kid has left it in there ?

    They were being defiant by adding a label?

    Just tell them you want a new one and send it back!!

    It could be a mistake or it could be deliberate, I'd have a bit of a moan and try to get some sort of goodwill gesture.

    The word "compensation" is thrown around far too much these days, what you've suffered is no more than a mild inconvenience and certainly does not justify any form of compensation what so ever.

    By the sounds of things you haven't even contacted the company yet, therefore how you can spout off about "awful level of service" and "compensation" over a minor mistake is beyond me?

    I believe that the company that sent the secondhand goods might have done it deliberately. If they did why shouldn't the OP be given some discount on a new one to compensate for their inconvenience. If it was a mistake then perhaps the same thing applies but they would then be compensating for their incompetence.

    Ask them for a 25% discount or you will be sending it back.

    Sounds like someone has returned it after wearing it and the shop didn't realise. Compensation, no. A new one or a discount I am sure they will oblige.
