    I have also got a Directions questionnaire (Small Claims Track) from the county court and Request for special direction pursuant to PD27 (2.4) with a blank form Notice of allocation to the small claims track (no hearing) which I have no idea to do with.

    What should I do if I want to carry on with this case?

    Following on from this post I have just noticed that in the letter from Gladstones it states that there is a copy of our client's completed directions questionnaire. Which is not the case it is actually blank. Have they made a mistake or do I need to fill in another a copy and send it to Gladstones?

    Hi forum - I am in a bit of a difficult situation as I am at the hearing stage which is next week Friday 11th. I have been dealing with this case on behalf of my mother and she has had to leave the country urgently due to family bereavement. In all honest I have not given this case the attention it needs.

    I have not started my WS but I have received the claimants WS and I know now that I should have done this 14 days before the hearing. In my current position can I have this hearing postponed due to extenuating circumstances to buy more time, I have flight detail of my mothers flight and any other information needed. I know it will be difficult for me to write a WS before the hearing due to my dyslexia. I know there is an option to write to the judge to have this hearing heard in our absence but I am worried we will lose the case.

    Any advice is much appreciated

    You can not appear for your mother in her absence unless a solicitor. So you may lose by default unless you get agreement to postpone.

    Indeed, your mother MUSt appear, and this is HER witness statement so she should ideally write it.

    You must URGENTLY - NOW, TODAY - call the court and see whathtey can do. Hopefully you cna get this adjourned.

    Or write as her (NOT AS YOU, YOU ARE A THIRD PARTY!) say she is out of the country and can the case be heard on the papers. Send a copy to the other side as well.

    I wrote a letter into the courts to have the case adjourned and the witness statement and evidence is yet to be submitted.

    I have received a letter from my county court with a new notice of hearing on the 24th of July but it does not state when I should submit the witness statement. Do I need to submit a witness statement as I am looking to rely on the defense I have submitted in court?
