    You do have the Particulars of Claim - there are in the box headed 'Particulars of Claim' on the first page.
    (you might want to remove your car reg no from that box)

    Those PoCs are woefully inadequate.

    Since 1st October Claimants need to provide much more information.

    You need to highlight this failure.

  • Thanks I have removed my reg. What do you think of my draft defense is there anything I should add apart from the new protocols that claimants need to ahead too Since 1st October? Is the length and structure ok?

    Have you read any recent Gladstone defences?

    Look again at post #2 of the NEWBIES thread and read some of the defences to see how yours might be improved.

    actually , its overleaf and not been edited despite several replies telling you to refine it

    it doesnt even have a statement of truth at the bottom , so is incomplete

    if you really wanted help , you have had 2 to 3 weeks to refine your initial draft and post the final draft on here for checking

    until you do that , you wont get somebody to critique it with a red pen

  • I have received a letter from Gladstones Solicitors stating:

    "We act for the claimant and have notified the court of our client;s intentions to proceed with the claim.

    Please find enclosed a copy of our client's completed directions questionnaire, which will be filed with the court upon their request. You will note that we intend to request a special direction that the case be dealt with on the papers and without the need for an oral hearing

    This request id ought simply to make.... thing straight forward and keep cost low.. we trust you agree

    You will note our client has elected not to mediate. Its decision is not meant to be in any way obstructive and is based purely on experience , as mediation has rarely proven beneficial in these types of cases. Notwithstanding this, our Client would be happy to listen to any genuine payment proposal that you wish to put forward."

    I have also got a Directions questionnaire (Small Claims Track) from the county court and Request for special direction pursuant to PD27 (2.4) with a blank form Notice of allocation to the small claims track (no hearing) which I have no idea to do with.

    What should I do if I want to carry on with this case?

    Read some more of post #2 of the NEWBIES FAQ thread where you will find that Bargepole's walkthrough tells you exactly how to respond to that.

    Post #2 of the NEWBIES FAQ thread really should be the first place you should be looking for guidance at this stage.
